    What first enters your mind....

    When you first hear the phrase " that law is unconstitutional" which of these two phrases do you think about first?

    OMG what rights are they trying to violate now?!?!

    or

    OMG what parts of the Constitution are they trying to violate now?!?!

    I would add in "OMG what idiocy are they trying to say is unconstitutional now" but this poll isn't about that particular thing.

    When I hear the "law is Unconstitutional" I think that the law may not apply Constitutionally but applies to "Case Law". Sometimes laws are created based on case law which is supposed to be based on the Constitution however, that case law may not be and may never have been challenged, therefore the fault of the law is amplified over years and many other case laws implemented until it's an absolute abortion. How often this happens I'm not sure...
    I think if Thomas Jefferson were looking down, the author of the Bill of Rights, on whats being proposed here, hed agree with it. He would agree that the First Amendment cannot be absolute. - Chuck Schumer (D). Yet, Madison and Mason wrote the Bill of Rights, according to Sheila Jackson Lee, 400 years ago. Yup, it's a fact.

    I think: "Is it? . . . Where's the text . . . let me read it . . . where's related Sotus rulings . . . let me read those and contrast and compare"

    When I read "that law is unconstitutional" I assume the person who wrote that is expressing his/her opinion that a specific law is unconstitutional....as in it violates what is written in the Constitution. Most of the time a person making that claim believes a specific law is not based on what the Constitution says, rather, it is based on what a law maker thinks "should" be in the Constitution. This Country has strayed so far from the Constitution I wonder if we will ever get back to a state of afffairs that would not make the Founding Fathers cry in disgust.

    Aren't the two options really one and the same?

    Anyway, if you had asked me 20 years ago I would have picked option #1. Today, after interacting with so many people, my first thought would be to question if they actually knew what the Constitution was about. Unless I already knew the person, and if they did know, then I would skip to thought #2.

    Well, this could be applied in the form of rights or laws that appear unconstitutional, like "hate speech" laws or the Patriot Act. Both appear to contradict the Constitution.
