Seriously. A billboard??!

Should he be forced to take it down?

Well, it's a bit unclear what the facts in the case are, but the woman claims that she had a miscarriage and not an abortion. If that's true, then possibly the billboard is libel.

If she actually did have an abortion, then it should definitely be allowed. It's no different than the billboards you occasionally see with women publicly shaming their cheating husbands.
 
He didn't mention her name. I don't have a problem with it. Freedom of speech and all that.

It's hard to really say. I think that for the most part no one would have known anything about the woman had it not gotten the press it did. In and of itself it doesn't name anyone. While the court did order it down, jail time for something like this seems maybe a bit overboard. And then there are really the questions of 1st vs 4th. Though in this case it's the government force being used against the 1st, not 4th (that was individual, if one wishes to make that argument).

Now thats out of the way, his name isnt up ther, her name isnt up there so Im not really sure where the legal part comes in.

Like some one else said if she didnt get an abortion that libel but again, no names were mentioned.

Also invasion of privacy could apply because its medical history/procedure but again no names were mentioned.

Tough call indeed . . . . . . .

Im thinkin its right to take it down, and the jail time is if he doesnt comply with the court order so i have no problem with that.

If she had a miscarriage (there is some debate about that in the article), I believe he could be sued for libel, I am not a lawyer though.

Also, he looks suspiciously like he wants to eat the child.

Looking at the wiki, if the lady is easily identifiable, then yes, I guess it hinges on that.

thats a TOUGH call, there is implied communication but its hard to prove.

For example if Mrs. Conan/Terminator posted herself on bill boards and it said my ex husband is a lying cheating bastard with herpes. lol

thats probably libel if he doesnt have herpes, IF lol and its probably harassment because Im guessing because of how famous both of them are the judge wouldnt view it as not being named, we know damn well who she is talking about because of their fame.

Now thats NOT the case her but it leaves the door open.

But a Judge already ordered him to take it down

free speech doesnt allow you to harass or be libel or invade another person privacy like medical history, conditions, procedures.

Neither her name, not her picture are on the billboard. Should all his exes sue him now? How do we know which ex-girlfriend he's talking about?
