Seriously. A billboard??!

Should he be forced to take it down?

On what bases? Being a dork is no reason to be sued, even in NM.

On what basis? If nothing else, court costs for what it cost her to take him to court to get the sign taken down. I'm pretty sure punitive damages can be added. Maybe I shouldn't say pretty sure, as I believe it varies from state-to-state.

I don't know what her original complaint included, or what court heard the case, or even what the final judgement said, but she probably got costs, if she paid any herself. As for punitives, his offense would have to be egregious. She hasn't been harmed that badly, has she?

But we weren't scorned. I personally just don't suffer fools gladly.

I'm also glad my daughter never encountered a jackass like him.
 
Well, it's a bit unclear what the facts in the case are, but the woman claims that she had a miscarriage and not an abortion. If that's true, then possibly the billboard is libel.

If she actually did have an abortion, then it should definitely be allowed. It's no different than the billboards you occasionally see with women publicly shaming their cheating husbands.

I have never seen billboards shaming cheating husbands, but this is a form of harassment and I don't think our public space should be used to cause people emotional pain or damage. This is a form of bullying as far as I am concerned, and this is adults. Adults should set a better example... and if it results in personal loss, discrimination, etc. for his ex, then she has every right to sue his ass off.

I would agree with you, if it was just a billboard sending a message and he was just a model/actor whatever. However, this message is intended for his ex... though it doesn't mention her name, it is still directed at her. If he is going around and saying her name and saying that billboard is for her, then that changes the whole thing. He is using public space to bully and harass her, and our communities should stand up to all forms of bullying... Children are killing themselves due to harassment and bullying. Bullying of children, adults, or anybody shouldn't be turned into a damn public spectacle or embraced as freedom of speech.

I don't think so. Abortion is legal. To say someone had an abortion is not a tort, even if they didn't. At least I can't see why it would be.

But that's what I thought was curious about his board. He didn't use the word abortion. He said, I think, kill. Now that could be a tort, but even then the girl's identity would have to be made known, too.

I don't know. Lawyers?
 
It's hard to really say. I think that for the most part no one would have known anything about the woman had it not gotten the press it did. In and of itself it doesn't name anyone. While the court did order it down, jail time for something like this seems maybe a bit overboard. And then there are really the questions of 1st vs 4th. Though in this case it's the government force being used against the 1st, not 4th (that was individual, if one wishes to make that argument).

All I am going to say about the guy is that he seems like a seriously creepy ex boyfriend... taking a billboard ad to gain your attention! I mean, ****, she had an abortion... she decided she didn't want to be with HIM, broke up with him, and had an abortion. This guy comes off as angry and bitter AT HER, and unwilling to let go.

I'd guess his own behaviour before the abortion and break up, influenced her decision to abort and break up. I am guessing he probably had some kind issues and creeped the poor woman out... Good God, I hope she never has to deal with him again.

His face is used... If you know him, even casually, you might be able to figure out who he is talking about. Furthermore, he might be telling people personally whom the billboard is about. If it were an actor/model holding a ghost baby, that would be different... If she can't prove the billboard is directed about her, then we wouldn't have probable cause to believe the billboard is about her either... but that's not the case.

The guy is a creep. This is his ex girlfriend who probably doesn't want to talk to or have anything to do with him. I think this is stalkerish and all around creepy.

If my ex posted a misleading billboard about me in our community, I'd freak the hell out and try to get it removed.

Neither her name, not her picture are on the billboard. Should all his exes sue him now? How do we know which ex-girlfriend he's talking about?

LOL... the one that had the abortion/miscarriage.

How many of his exes had an abortion/miscarriage? If only one did, then it's obvious who he is attacking in the billboard.

He is odd, abortion or not. His ex wants nothing to do with him, and he bought a billboard as a way to intrude into her life and get her attention. Yes, they are communicating again... in a courtroom. The guy is a total creeper.

To me it seems the man, his feelings, and everything about him are not wanted here. The man has no right to be mad that his child was supposedly aborted.

I do too. She had a right to get an abortion, if she did. He had a right to put up the billboard. Both were idiots. Neither deserves to reproduce. Stop the stupidity now.
