Pretty darn funny. The young punk is running his mouth, gets his ass BEAT down bad, then afterward he's STILL running his mouth...problem is that's obviously all he knows how to do.

Now on the flip side, legal analysis.

Old Dude and Young Punk have a verbal dispute. Old Dude moves away from YP, moving to the other end of the bus. Legally this was retreating from the dispute. YP keeps running mouth, gets up and goes to where OD retreated, starts ****. OD beats his ass. Most jurisdictions will say OD acted in self-defense.

YP is the sort you have to watch out for, a hothead with an overinflated ego and likely to hold a grudge: might shoot OD later if he gets a chance.

I heard Old Dude telling YP "I'm sixty-seven, you can't scare me." LOL. Old Dude has probably already had a heart surgery or two and knows that there are no guarantees once you're past 70, so yeah it WOULD be hard to scare him. I'd take even money OD is a vet also. :)

Not sure. But there was obviously a shoe shining comment. Not sure who was the first to start the shoe shining thing though. Dunno if the old dude began with it or the the young. Watching the video of Epic Beard Man after his win makes me think he may be ****ing crazy. Or a genius instigator.
 
The young guy could be charged with aggravated assault then. The old guy was just defending himself though.
 
His only defense would be to say the man aggravated him into a state of frenzy. And/or he was confused.

"Brutal fight frightens California Travelers" WTF? It wasn't that brutal. YP got his ass beat about medium-well, but I'd seen worse before I was 14.

The thing about trying to make about racism and claims that the white guy started it.... I don't know. The video starts with the white guy asking about a shoeshine, and the black guy taking offense. We don't know what was said or done before that point, so we don't know who first suffered from diarrhea of the mouth. At any rate, Old Beard Guy retreated from the confrontation and was attacked... he has a pretty strong self-def claim.

That's the way I see it.

One of the articles said that police took both of them to the hospital. Evidently the old dude was not taking his meds ..hmmm ;)
 
The person taking the video obviously had a bias. This might have been a set up to watch some punk-kid fight an old man.
 
Yeah, I think the recorder was black and wanted to see the old white guy get his butt kicked:confused:

anyways you never hit an old person, never.
 
also the female who was recorded should be arrested for stealing the old man's bag.

old dude retreated, the young dood not only followed him but hit him as well...

Clear self defense....



You can also see use of "appropriate force" as he did not hit the young guy after he was down, and retreated off the buss.

That video was funny.That almost reminds of this re enactment of this old lady on a 1000 ways to die beating the crap out of a would be purse snatcher.Although I have to wonder how accurate that show is.

She can be heard saying "Beat his white ass!" during the video. (I hate racists).

I rode a city bus in Berkeley every weekday for about a year, and saw stuff similar to this but never ending in a beating.

Once, though, this guy got on the bus who obviously knew another guy already riding. So the guy already on the bus picks up his duffle bag and tells the guy not to get near him and shows him the handle of a machete sticking out of his bag. so then, they begin bickering, and a few stops go by, and they get off together and get into it. but the bus sped away before anyone could see how it ended. here in the midwest we don't often have that kinda drama. i don't miss it.

I want to know what actually STARTED the argument.

I remember from my public transit days, people could be huge dicks for no apparent reason and it wasnt always the "young punks"

Well, they are old, their bones are easy to break and really their bodies don't have to muscle or bone mass comparable to a young guy. And normally they are also slower too. Which makes them very easy targets. That's why a someone young shouldn't ever hit an old person. Its like beating up a child. You know they can't defend themselves.

I care. I dislike it when people AUTOMATICALLY assume that because a person's young and involved in a conflict that they started it because they're a "young punk".

That attitude bothered me a lot when I was younger and it bothers me now. So I want to know what happened before I pass judgement. It's perfectly possible that the older man said something that pissed the kid off and then kept antagonizing him.

In some states, "I was in fear of my life officer" and a bullet to the head would have been justified.


Antagonizing is no reason for striking an old man or anyone for that matter.

Honestly, if someone is going to get in a position where they're scrapping (in general) then I would assume that they have full confidence in their ability to defend themselves regardless of the reality of the situation. There would be little honor in defeating an opponent who was older and more frail, but if they're determined to get into it...

You know, i don't think that a punk cares about age, height, etc. If he wants to fight he is going to fight against whomever. I don't think there is such a thing as honor anymore. Too many people run their mouths off, ie Italian-Americans.
