In today's digital world, we are all exposed to our conversations being recorded by a smart phone, a security camera with sound, or in my case my Samsung TV, without our consent. It is likely that NBC's affiliate broke the law by using a clearly off script conversation and making it public. When the dust dies down, and the lawyers sharpen their knives, it will be interesting to watch because the outcome will affect us all.
Did Trump know he was being recorded? If not, a hot mic can be a criminal act in California, and NBC potentially liable. California Penal Code 632 criminalizes any person who “without the consent of all parties” records their conversations. California Penal Code 637.2 specifically authorizes the right of the person whose privacy was invaded to bring a civil suit, with an incredible treble damages provision for RICO-style punishment.
