The Republican Senators should negotiate a replacement for SCOTUS now

I believe the Republicans should negotiate a replacement for Scalia with Obama. They have the power right now to dictate to Obama to nominate a moderate that could be at the least neutral in many of the issues at stake right now. I think if they hold the line and force the next president to be the one to nominate the new judge they could find themselves facing a Democrat president and Senate. At that point they could end up seeing a transvestite from San Francisco being the next judge.

OK, I don't know if there is even a trany judge available in the country. I am just using the kind of fear mongering that seems to work with the Republicans. The real point is, they have some say in this process right now. If they stick to the obstruction, could they end up "cutting off their nose to spite their face?"

well, I don't really care too much ... but I think you have too much faith in negotiations with Obama...he's not the compromising sort... and neither are the Republicans.

in any event, no matter what Obama does, Republicans will have a say in it... they own the Senate , and it is their duty to consent to Obama's nominees, or to kick them to the curb.

I have not been able to swallow this "Kool Aid" that the problem is Obama is not able to compromise. The Republicans have made it clear that they are not willing to compromise and trying to hang that around Obama's neck has never made sense to me. If the Republicans attempted to make a compromise with Obama on this issue, it would be the first time they ever tried.

The Republicans are waiting because they plan on winning the election, and be in position to get a much more conservative judge.

You're assuming that what they are actually worried about is getting as conservative a judge as possible on the bench. In reality, if they hold a vote on any judge who isn't scalia brought back from the dead, their voter base will flip out and guarantee either a loss in the presidential race, or maybe a Trump presidency as well as just cement in this silly idea that the republican establishment is not fighting against Obama in any way (which is insane). If they hold out and then happen to lose the presidency, oh well, no one can complain because they did all they could do blah blah blah and they live to fight on.

They are stuck in a very hard position. The names that Obama is floating are absolutely unanimously praised legal minds that have received unanimous up votes from congress in the past. It's very hard to argue that these people aren't worthy and we should go over a year with no 9th judge without very clearly showing that you're just playing politics.

Agreed that Obama should at least nominate and leave the Senate obliged to act. I did not think I was indignant, just asking for conversation about the strategy of risking the election. I don't think the Republicans can afford to assume they are going to win the presidency. I suspect they can assume they will hold the Senate, not the White House.

If they play their cards right, they just might get to block a Sanders nominee for four more years.

True that. But castrating the Supreme Court by leaving it unable to make a decision on any significant issues will not reflect well on them. They can get away with the remainder of this term but to think there is no ramification for dragging this out further could be dangerous. They certainly cannot afford to lose all of the branches of government. Talk about the base flipping out.

I do not recall the Constitution on Supreme Court appointments having the qualifier "advice and consent... only when politically advantageous to do so."
