A Brazos County jury awarded a $27 million verdict in a civil lawsuit against McDonald’s following the 2012 deaths of two Blinn College students.

Denton James Ward, 18, of Flower Mound, and Lauren Bailey Crisp, 19, of Dripping Springs were killed when they ran a red light at Texas and Holleman Drive. They were on their way to the hospital after being beaten by a mob at the McDonald’s on University Drive.

Their parents claim the deaths could have been avoided if McDonald’s had hired security guards to prevent the fights that had happened regularly over the past year.

WTF?!?! First off McD's is a franchise so the first responsibility is to the owner not the corporation. Had this been a chain like say Target or Wal-Mart, then it's a whole different story.

Sure but I went out in college a lot and rarely saw that type of incident. They had 210 police calls over a 3 year period, hats a lot, Not to mention a guy that had managed that restaurant for 11 months during that period claimed to know nothing about any violence not to mention all of his supervisors also claimed to know nothing. I dont think that McDonalds should be held liable for the majority of the damages like the jury did but they certainly deserves some portion of the blame for looking the other way to the massive amounts of violence happening on their property. The family only asked for $1 million the jury gave them $27 million that should show you how bad McDonalds look in court.
 

There is craziness all over this case. From the mentioned article:

One of the attackers, Marcus Jones, was sentenced to 90 days in jail for assaulting Mr. Ward's friend. No other arrests were made. College Station Police officers testified they regularly were called to the location to break up fights and disperse unsupervised crowds numbering in the hundreds between 2 a.m. and 4 a.m. on weekends. Despite that testimony, two former managers who were working at the same McDonald's that night testified they were unaware of any problems.

Only one assailant was arrested and only given 90 days in jail although it resulted in deaths????? Two former managers who were working that night were unaware of crowds fighting in the parking lot???

It is Texas so take that into the picture.

Wouldn't be the first idiotic lawsuit that happened to McDonald's. Too many people always want to blame someone else.

I have to think this is a lack of police enforcement. If they knew violence was occurring on a regular basis there, they should patrol that area.

Yes. McDonalds allowed the activities on their property. Said activity had a negative impact on the two, making them flee and seek medical attention in a beaten state.

Hey, cops are busy. Busy with people speeding or their yards need mowing, or sagging pants.

Depends, there is crime that happens all the time in many areas, the cops can't be everywhere at the same time.

It is their fault that the kids were so panicked and scared that they ran a red light...
 
And the McDonald's wasn't anywhere near the intersection where the accident occurred. They were in a bar in the Northgate area, and underaged drinking may have played a part in the accident.

Chain o' Blame:


A. If they died in the crash, as one claim goes....

1. Driver of the car that crashed.
2. Possibly driver of the other car, if they did something contributory.
3. Mob who beat and stomped the deceased, causing the GFs to rush them to ER.
4. McDonalds if they did indeed have all these problems without trying to deal with them.
5. Local LE for not dealing with the violence decisively. (yeah, I know, SCOTUS says no liability... :( )

B. If the boy was beaten/stomped to death in the parking lot before the accident, as another claim goes...

1. The attackers
2. The drivers
3. McDonalds
4. LE
 
Here is a local update. Among the interesting bits of information is the fact that the McD's manager claimed not to be aware that the police had been repeatedly called to his store. He lied. A comparison/contrast of other local McD's and their security is also provided. From the Eagle:

Steele, a plaintiff attorney who also has experience as a civil defense lawyer, said he expects one of the major issues on appeals will be whether McDonald's can be held responsible for Crisp's death.

"I think the appellate courts are going to have a hard time with this jury putting no responsibility on the driver," he said.

Steele said he'd expect the 10th Court of Appeals justices to order both sides into mediation and suspects appellate judges may take issue with the finding of damages, which were all actual, or non-economical, as opposed to punitive.

It's possible the appellate courts could affirm the jury's verdict when it comes to Ward, but find legal sufficiency issues exist in the findings related to Crisp and send her claims back for retrial.

Another reason why American tort law is so in need of reform and why Americans better soon turn around their need to blame everyone but themselves for their mistakes or your society is going to rot from within.

Tort reform is sorely needed, yes. One of the reasons healthcare has become so expensive is lawsuits and their costs. It has been said that we possibly wouldn't even 'need' Obamacare if tort reform had been enacted years ago instead, but now we have it and tort reform is still nowhere on the horizon.

Sorry for the off-topic tangent. But yeah, we seriously need tort reform.

It's not off topic and you're absolutely right. Insurance costs, all types, are out of control in the US because your courts are too receptive to lawyers who are quick buck artists that convince anyone who suffers loss of any kind to sue anyone involved no matter how remotely they may be involved. The only ones who really profit are the legal scum in the tort bar.
