This is unacceptable!!! You're ripping apart a family right at the moment of birth. It's either kick them all out or take them all in people!!!

I have heard of this before,

So should a child be born in USA, the child in an American, but parents are not, and thereby parents are sent back while children are sent to child care centers or foster homes?

Is this why 7-9 month old pregnant women are not allowed to enter or even travel by plane (i.e., they may give birth while flying above American soil)?

They are called anchor babies, and are born here purposely to create a situation for the illegal parents to stay here. That is not what the 14th Amendment was intended to do, no law is passed to induce lawlessness. Any such interpretation is bogus.

if those are the only two options, i suppose they all have to go back.

If the fourteenth had a clear objective it would have named slaves instead of the much more general "persons."

You could fight to amend it, theres always that. Until then, welcome to the constitution.

Misinterpretation of the 14th Amendment's Citizenship Clause.

They weren't all slaves, and besides that is not much of a legal term.

We don't steal their children. His does it rip them apart?

Birthright citizenship is rewarding law breakers.

Speak for yourself.

That's what I did. Entering this country illegally is breaking the law. Anchoring lawbreakers is rewarding illegal behavior

If they were not slaves there would be ZERO need for the 14th Amendment, keeping the terminology vague covers ALL not just the slaves freed during the War Between the States. Interesting how some argue the comma in one amendment but insist words that are not in another were meant to be...

When the word persons was used, it opened up the amendment to interpretation for anyone, because we are all people.

No one cares if you think that person isnt much of a legal term, here is the quagmire you are in. And the only way youll be able to fix it is by amending the constitution. GL HF.

And GG for when you find that its a fruitless battle for you.

Great, we have an incentive for illegal immigration and nothing can be done about it. Good riddance to the parents then; come back legally next time!!!

And yet, the child who has done no lawbreaking, gets punished for the actions of another. The Child is an 'innocent', to borrow an anti-abortion label. Why are we punishing people who have committed no crime, to borrow a theory from those who oppose any new firearm regulation. The foundation of a stable society is a man and wife raising children, to borrow the claims of those opposed to SSM...

Now we don't kick out people for breaking our laws. We don't 'nuclear option' a minor offense. We have a wide variety of punishments for law breakers- from probation, through fines and community service to jail time. I'm sure we can find something less drastic than throwing otherwise good intentioned folks out of the country.

So the choice seems very clear- the 'Greater Good' is to keep the family together and not punish Innocents for the actions of others, but rather fine those who came in without proper documentation.... :peace

Something can be done. Are you ignorant of the American legal system? Are you American?

The constitution can be amended.

I feel for the kids. They did not do anything wrong. No one is arguing that.
But do we punish, or should the parents be held accountable? Isn't it the parents who are gambling their child's welfare?
Of course by now our laws are such a joke that the odds are heavily in their favor.

I doubt anyone would want to do something like that unless immigration goes out of control due to this (which I doubt). This is trivial to me because it's only a small part of the whole immigration issue.

Did I invoke the Born Again theory of accountability- 'Go forth and sin no more, all is forgiven'...???

No, I was pretty clear we have many options for punishing immigrants without the proper documentation. I don't see the gamble. If we were honest about immigration the parent would face fines for not being documented, register for tax purposes and be put on a pathway to citizenship... :peace
