Would anyone be able to point by me in the direction of Florida law and apartment complexes? I'm curious what authority the complex would have to:

1) keep me from owning a firearm in my apartment?

2) legal action if...say...per terms of lease they say no defense...I mean no guns...and I use my gun in self defense on their land?

I am talking specifically Florida. If you know for your state I would like to hear out of curiosity, but I haven't been able to find anything on the law in Florida.!

well I don't know florida law but if you violate a lease-trust me-the consequences of that are GOING TO PALE in comparison to actually having a legitimate need to shoot someone and not doing it. or doing it legally.

They can put that in a lease and it is legal. Changing it might be another story.

So if it is in the lease do they have any legal action they can take? Like criminal law? Would it just be civil? I ask because I'm in an apartment complex and I'm curious. Their language doesn't bar me, but it does state firearms must be incased. So they can kma on in the apartment. But civil law concerns me. Plus they aren't a barred establishment for concealed carry.

Its up to the landlord really. After all, an apartment is still private property.

With that said, look at your lease, it's all about the lease really.

Source = mother, certified realtor and landlord of multiple properties

Expect an eviction if it really got to civil law.

Also, you should really just seek a landlord who will allow guns to a level that you find comfortable. Getting an eviction is horrific. Once you have an eviction on your record, you'll never get a good apartment again. My mom runs eviction background checks and Im sure every other mediocre and above mediocre landlord does as well.

true but if he has to shoot someone-I mean really has to shoot someone and cannot because he doesn't have a gun or does, because he has, the issues will be far more important. and if he has to shoot a scumbag and does-public sentiment will be hell on the landlord to evict someone who had to save his own life

True, but if the landlord finds a gun before any criminal thnig happens, the public eye is blind and you have an eviction on your hands.

It's just better to find a gun friendly landlord. Its no different than wanting pets and confronting a landlord who doesnt like, pets.

I had a hard time finding any info that I would count as factual. It seems like it would have to be civil. If your lease doesn't have it in there they can't change it mid lease.

You have to be given 24 hours notice before they enter your apartment unless they are doing it for reasons like you are in danger. That means you should have ample to time to lock up any guns before they get there. Of course, if you're not in the house, they should be locked up anyway. ;)

Exactly. The one nice thing about where I live now is no "surprise inspections." They did that at my old apartment and tried to charge me pet fees for having a kennel that I was storing while I was moving out. Turns out it wasn't worth the hassle of trying to get me to pay $170 lol.

Wow you must have a strict landlord, i have never had a landlord walk through where i live, of course i live in a single wide not an apartment, and at the trailer park if anyone trashes the place too bad, she can have it scrapped then buy another old model at auction for 500-1500 bucks and rent it out again.

For laws, it varies from state to state, plus county city etc can add to. Some places allow inspections with little notice, while some states are more strict. You also may have issues like the state says they can do a walkthrough on 24 hour notice, but the county adds to and says they need a week notice,or some places may not allow walkthroughs at all and may only allow the landlord to enter under an emergency situation, like a water main breaking under the house.

This is really just a curiosity. The place I live at is really nice and only enters if requested. The last place had inspections. Mainly because they were students based apartments and where I live now is for people around my age.
