A man in Oklahoma is hoping to change the law after he has to continue to pay child support for a baby that is not his, according to our affiliate KOTV.

When Thomas’ high school girlfriend got pregnant, he married her. Five months later she had a little boy and he believed he had a son, but their marriage fell apart.

Thomas decided to take a paternity test when the boy was three years old.

“It comes back zero percent. I was in my office and I saw that. I should’ve expected it but I didn’t and it hit me. I’m telling my co-worker how shocked I am that someone could do this to someone,” he said.

The judge ordered Thomas to take another DNA test and he got the same result. The judge first ruled that Thomas was off the hook financially, but then reversed the decision because Oklahoma law says men must question paternity within two years of the child’s birth.

Thomas said that he had no reason to question it before he did, but, because he missed the deadline, the judge ordered him to pay around $500 a month in child support and nearly $15,000 in back support – for a child that is not his.

This slut knew she had sex with another man, she should not get one cent...the slut lied and conned this man into thinking he was the father,, And now the court takes his cash and forcing him to give it to her or else

I hope he takes this to a higher court, the law is not about justice. Think I would also add civil lawsuits against both the mother and the actual father. This is not the first time this has happened and it will take someone with real determination to fight it and get this overturned.

Justice is seeing the child taken care of. He accepted and raised the child as his own. That acceptance trumps biology. Not the first guy to be cuckolded.

bull$hit...he was told by the mother he was the father....he accepted based on a lie and being misled! the real father should not be hard to find! Justice is finding the real father

He's the only father this kid has known. He is the "real" father. Doesn't matter that it was based upon a lie.

The money isn't for the "slut." It's for the kid.

The man raised the child as his own for three years and presumably formed an emotional attachment to the kid. While finding out the child isn't "his" biologically is no doubt a shock that shouldn't change the emotional attachment.

The court shouldn't have to order him to pay - he should be doing it willingly.
 
What in the world is the reason for the two year deadline?

So if a woman takes a baby at 1 day old from hospital. makes her husband think its his ...he plays father for 3 years

Than they find out catch the woman...do they return the child to the biological father? Or let the man that accepted child keep it?(acceptance trumps biology)

Yeah I suppose he could've have been supporting a child he thought was his and hated the kid or felt complete indifference to him the entire time. Certain not impossible.
Still doesn't say as **** load that's good about him.

Courts put the welfare of the child above everything else. After all they are only truly innocent party in these situations and aren't able to look after themselves.

IDK, you tell me. I couldn't find any cases where a cuckolded father got their parental rights terminated.

Doesn't this whole line of reasoning by the state encourage men to sleep with married women? That way if they get the woman pregnant the husband will pay the child support, not them. One of the rationals to support the existence of government imposed child support is that it holds men accountable for their children, but if the state is going after men that aren't the father of the child or children in question then that whole line of reasoning is faulty.

Also, you're forgetting the possibility that the man simply doesn't want to pay for the child, but still cares for it.

That somehow being a care giver trumps biological parenthood to the point where we just forget about biological parenthood all together in some cases.

He owes nothing, and any charges levied are completely unjust.
 
1) I don't get the two year time limit on asking for proof of paternity.

2) The guy accepted responsibility based on inaccurate information and should not be held liable because of that.

3) If it were me, I would ask for sole custody because after three years, biologically mine or not, there's no way I could give up that child. Plus, if I was told I had to pay for the cost of the child support, then I would demand that I be the one to raise the child myself.

4) I don't like reading people calling the woman a slut. Not even a little bit. The guy obviously had sex out of wedlock just like she did or he wouldn't have thought the child was his. We have no idea how many sexual partners he had, or she had before they were married. Every time I read someone calling this woman a slut in this thread, my skin crawls from the hypocrisy and sexism.
