Lawyers for a former State Department staffer who worked on Hillary Clinton’s private email system have notified a House committee that their client will not testify Tuesday morning, saying that he previously invoked his constitutional right against self-incrimination before another Republican-led panel of Congress.

...Pagliano’s lawyers have said that he fully cooperated with the Justice Department investigation under a grant of limited immunity. Pagliano invoked his Fifth Amendment right more than 125 times in a June 6 deposition before lawyers with the conservative group Judicial Watch in a civil public records lawsuit seeking Clinton’s emails.

Democrats pushed back fiercely, arguing that the committee is unfairly expecting Pagliano to open himself up to criminal liability, thanks to an outstanding criminal referral from Chaffetz that asks the U.S. attorney for the District of Columbia to investigate deletions from the server.

“What we have done is put him under threat of criminal prosecution,” argued Rep. Stephen Lynch (D-Mass.). “It puts him in jeopardy coming before this committee while that criminal referral is in existence. He’s an American citizen; I know the Constitution gets in the way of this committee sometimes.”

Look this is all pretty much played out. We KNOW...

Hillary lied form the beginning about the server.
They lied about the content.
They lied about the clasification.
They lied about its whereabouts.
They lied about its management.
We KNOW democrats exchanged emails in a concerted effort to protect Hillary.
We KNOW the democrats on the committe are invested in blocking the truth.

People say "why is this still going on?" Answer...because they have never gotten the actual answers.

But you know...

"What difference does it make?"
 
If he did nothing wrong, then he has nothing to hide. If did something wrong, then Clinton should be demanding his head on a pole.

No matter what he gets up there and says he is going to piss off powerful people. If I were him I would probably keep my mouth shut too.

Then both you and he are cowards. If he knows of wrongdoing and by his silence he protects that wrongdoing, then he is a coward. Courage is standing up to those who abuse power.

That was the worst spin I've seen in ages. Look at this logically:

If he did something wrong, then he's the solution to Clinton's problem with the deleted emails, he'd be thrown under the bus in a NY minute and rightfully so. It would be Clinton's lawyers demanding that he testify to clear her name.
If he didn't do anything wrong, then why is he refusing to testify??

The only other situation would be that he did something wrong and Clinton knows that it not only would put his butt in a sling, but hers as well. Now maybe I missed a possible scenario, so please feel free to offer one (or more) up for discussion...

Sounds more like he's trying to avoid becoming someone'svbitch in a Federal prison.

Seven sub-committee investigations on Benghazi concluded that Clinton didn't do anything wrong, either.

A person doesn't have to do anything wrong to be publically persecuted by congress.

So you have no plausible scenario to offer, just more hyperbole... Too bad, I was hoping that you'd make the effort to actaully have an intelligent discussion. I guess I'll just have to live with the disappointment...

This morning he was supposed to appear. He didn't. Now he is in contempt of Congress.

Not a good position for him to be.

If he appeared and pled the 5th, that would have been a different story, but I guess he didn't feel he had to.

Does continuing this political farce with more subpoenas have any legislative purpose what so ever? We have a justice system and an investigative agency...so why is congress acting as both instead of doing their job legislating?
