Women sue to block New York's 'Tampon Tax' - Mar. 3, 2016

Margo Seibert, Jennifer Moore, Catherine O'Neil, Natalie Brasington, and Taja-Nia Henderson, filed a lawsuit Thursday against New York's tax department and its commissioner, Jerry Boone.

Their demand: Stop imposing a 4% "luxury tax" on feminine hygiene products.
The complaint points to guidelines published by the taxation department in 1998 and 2014 that categorize pads and tampons as "general merchandise." That means they're not eligible for a "medical supplies" tax exemption.

New York women collectively pay $14 million in taxes on feminine hygiene products each year, the complaint estimates.

This seems so ridiculous that I have no words to really communicate my disbelief.

Some things that are NOT taxed: Rogaine, dandruff shampoo, foot powder, chapstick,...

Similar bills have been proposed in states including California, Utah and Virginia.

How many states TAX tampons and pads and such?????

I think women could change this law rather quickly if they simply collected all their used "products" for a few months and then deposited them,
all at once, on the steps of the state capital they live in. Imagine the sheer terror of the law makers who come in to work and stumble upon that.

When did "feminine hygiene products" become a luxury item?

If these are a luxury item, maybe politicians would like to see what happens when we stop using any of these items and go out in public. As absolutely disgusting as such a thing sounds, this is essentially what such a tax is supposed to be about, taxing something that a person could do without if they had some self-control.

Taxing everything via VAT is a good idea. In Germany they reduce the 19% level of taxation for certain types of goods like food or medicine, but levy gasoline with a tax that is presently higher than the gas itself.

The problem with this is not that they are taxing feminine hygiene products, but rather that they are being taxed and therefore recognized as a luxury item. If everything is taxed at the same rate, it is hard to argue that something shouldn't be taxed but if things are categorized into necessities and luxuries for taxation purposes, then there is a legitimate case to argue that feminine hygiene products are absolutely not a luxury item.

Yeah, if y'all could just control yourself and stop it, that'd be great. Nothing surprises me about New York though.

Okay, wow. I'm somewhat speechless for a second. I really need to let this one sink in.

What the ****? A "luxury item"? Luxury??

And what are California, Utah and Virginia thinking trying to dumb themselves down to New York's level?

What would have been hilarious is if the tax would have only applied to products advertising the "smooth glide applicator".

Seriously though, if I was a woman this would really piss me off.

I would have no problem taxing the ones with a plastic applicator as they are not biodegradable like the cardboard applicators.

lol, new york , 'nuff said. also, if this was a male hygiene product, would it be an issue?

Luxury item? So, what, I could just stop menstruating if I did 12-step? Gee, why didn't anyone tell me? I am really sick of women's bodies being regarded as superfluous and annoying.

Perhaps a bunch of free-bleeding women should hang out on their shiny white steps for a while. Hey, blood doesn't bother me, I'm used to it, but I get the feeling it will bother the old white men who think that women should be taxed for existing.

But moments like this, I'm rather smug they won't get a penny out of me anyway. Yay for cups.

and on that note

:inandout:

Perhaps they think menstrual huts are more practical? Sure they cost more up front but you'll save in the long run!

I don't even have a reply because some lunacy is even beyond me...

I can think of one use that would make them taxable:

Hell I'm not a woman and it pisses me off. If you are going to do targeted taxing, tax things we don't want or are bad like we do with cigarette taxes, not things like this. Its absurd.

Awweeee... you feeling left out? Was it your turn to be the victim?

The only thing a period should stop is a sentence.

Luxury.

I can't believe I've never really noticed they are taxed but I usually just want to pay for them and get the hell away from everything and everyone at that time.
