In Capital offense cases, generally there are two verdicts and in criminal cases often two trials. First, there is the question of guilt. If guilt, then the question of the sentence.

I think the problem many people have with the death penalty is that innocent people have been given it.

I'd like to see TWO levels of "guilty" that can be determined in death penalty cases.

The current standard of "beyond reasonable doubt / to a degree of moral certainty" does NOT require absolute certainly, just pretty damn certain.

I'd like to have a higher level of guilt necessary for the death penalty, somewhere along the lines of unquestioned certainty excluding supernatural possibilities.

There are cases where there is absolutely NO question the person did it. Such as someone caught doing a mass shooting, caught in the act, caught on video, etc. In those instances, the concerns of an innocent person being convicted are none.

This would ideally eliminate the prospect of an innocent person being executed. I think this could eliminate one very legitimate objection to the death penalty.

It could be as simple a choice of between "beyond reasonable doubt" OR "with certainty" as the two verdicts choice for the jury. It would be in 3 stages. The LONG "guilt or innocence" trial. If guilty, then the jury to decide if the evidence shows absolute certainty of guilt (and the law could place certain evidentiary requirements such as not based on circumstantial and/or just eye witness evidence). If the jury also finds absolute certainty, then and only then does the jury decide life sentence or death.

13 days ago two dutch brothers aged 9 and 7 went missing. Ruben and Julian had been picked up by their father for a short holiday, the 2 children were living with their mother. On May 6th he and his children were seen fueling up their car near where I live in the Netherlands (Neerbeek in the most southern province of the Netherlands) the time was 22.15pm. The next morning at 8am the remains of the father were found in a wood near Doornse Gat. He had taken his own life. His children were nowhere to be found.

In the next following 13 days Dutch police, members of the armed forces and masses of volunteers have searched numerous places around where the father was found and where the children were last seen alive. This morning police choppers and an F16 fighter joined the search for signs of possible burial plot.

About 12 hours ago (Sunday May 19th at approx. 15.00 hours local time) a witness saw human remains in a pipe connecting 2 little brooks. The place was about 6 to 7 miles away from where the father was found dead. Police closed off the area and forensic teams where dispatched. At about 23.00pm local time the police had a press conference and informed the dutch public that the bodies found in that water pipe were indeed the bodies of Ruben and Julian. The identification had been done by items found on the bodies of the children of which the police knew the father had bought them shortly before he killed himself (orange straps for tying down loads and luggage) and clothes the children where known to have worn on the day of their disappearance.

Almost certainly the animal/evil "son of a you know what" has killed his children.

Today I also read of a British father who has killed his 2 children (a 10 year old boy and a 5 year old daughter) by slitting their throats.

Sadly things like this happen way too often. And not just with people from some cultures, parents who kill their children is something that happens way too often. These people should be punished to natural life and should die in jail, preferably after dozens and dozens of miserable years.

That link suggests it has. I agree, but please feel free to challenge me on that one. The question I'm asking is if there was a study or something conclusive out there saying if alcohol was not advertised on TV, or radio there would be less people drinking, less alcohol related accidents, and fatalities. Would you support that? Or do you think regardless it should be allowed to be advertised on TV/radio? This thread is less about wether or not banning it's advertisement on TV/radio would do anything and more about if it would benefit society would it be worth the loss of that freedom?

Sorry in advance if this is the wrong place for this thread, there seem to be a lot of sub forums and I wasn't quite sure which one this belongs in. I'm sure I'll find my way around eventually...

I'd like to present a small part of a manifesto that I'm working on. The following section of the document lays out why I think democracy is something to fear, which I've tentatively titled "A Critique of Democracy". Later parts of the manifesto (which I will happily post separately) deal with other solutions that I see as being more ethically justifiable, but the general gist is that people shouldn't have a right to micro manage each other's lives, even if they vote on it.

Quote:

 A Critique of Democracy

Democracy assumes that one group of people have an inherent right to control any smaller group that disagrees with them. This is fundamentally unethical and unjustifiable.

Democracy on a national scale relies on constant threat of state sponsored violence, kidnapping, and extortion in order to enforce and sustain itself. This is an inescapable truth that many choose to ignore, but few would attempt to refute with any sort of factual argument. Even if you are fully aware that your government has used your tax money for illegal or illegitimate purposes, you will still be faced with violent arrest, imprisonment, and state sponsored kidnapping of any children you may have if you refuse to comply with their financial demands. Without threat and use of such tactics, democracy in its current form would cease to exist. It may well be the case that a majority of voters support such actions, but that serves no purpose in attempting to ethically legitimize them. Violent aggression is still violent aggression, even if you vote for it democratically.

If anyone reading this would like to refute this point, I challenge you to find a "democracy" anywhere in the world that doesn't officially resort to violence and imprisonment as its default punishment for non-violent non-compliance with requests to fund its existence. By definition, this is extortion, and is the key foundation from which democratic societies are funded.
Democracy by itself offers no protection for minorities, or anyone other than those aligned to the ruling party. In a pure democracy 51% of people could opt to kill the other 49% in gas chambers, as long as they take a vote on it. Remember what you learned as a kid about how two wrongs don't make a right? Well, forget about that if you live in a democracy. Two wrongs will make rights all day long in any truly democratic nation, as long as people are willing to vote. That is the very essence of democracy; mob rule, pack mentality, strength in numbers to oppress those with fewer numbers than you. Fortunately, nations have realized this, and rely on undemocratic constitutions and acts of parliament as backstops. While they never outright admit that democracy would be utterly horrific without wholly undemocratic foundations, in practice it is something that is rarely argued against. This in itself can be seen as strong evidence of the failings of democratic principle.

Democracy on a large scale is in the best interests of no one. Humans are diverse, and have a wide variety of complex preferences and beliefs with regards to how life should be lived. As such, it is unreasonable and unrealistic to assume that there would ever be a situation where 51% of people in an entire nation would agree on the finer points of important public issues such as fiscal planning, health care, education and so on. The result is that in order for any of a person's individual beliefs to be represented, they are forced to sacrifice others to form a collective majority, resulting in what is known as "tactical voting". This is basically a lose-lose scenario, where you are forced to vote for someone that you know from the outset doesn't represent your beliefs, simply for the sake of self preservation and avoidance of worst case scenarios. The practical implications of being the the minority in a democracy are the same as they would be in a dictatorship.

It is a common fallacy that democracy represents individual freedom. Nothing could be further from the truth. Democracy is founded on the assumption that you have whatever freedom the voting majority chooses to give you. Historically people have voted to kill or enslave each other with alarmingly high frequency whenever they are given the choice to do so.

I would appreciate any feedback, thoughts, or criticisms. The reason I'm specifically asking for feedback about this is that while I was trying to do some research, I realized that there actually isn't that much discussion on the topic. People just seem to think that democracy is a good thing and that seems to be the end of it. Have I lost my mind, or are my concerns legitimate?

Felony Franks is a hot dog joint in Chicago...they only employ felons. I think that's pretty cool and thought of it because of the thread on the protesting fast-food workers in Connecticut. They've bee around for about four years. I notice they've recently expanded into Los Angeles, starting with a food truck.

Isn't this a great idea??

And then I Googled jobs for felons and look what came up:

Jobs for Felons: List of Companies That Hire Felons

I'm really surprised and wonder if newly released felons know about these places. I've always heard they have a helluva time finding jobs.

And how about felons at McDonald's and other fast-food places? At least it would be something to get them started. If you can live with family and make minimum wage or somewhat above for a couple of years, a person could get on their feet.

Your thoughts?

Quicker closure for all involved. The victim and their families can get on with their lives sooner and maybe even avoid having to relive the horrific details on the witness stand, hear others testify of their nightmare or constantly be reminded of what happened every time they turn on the TV or are in line at the grocery store. Even innocent members of the perpetrator's family would be afforded a faster path to normalcy and going on with their lives. Once all pertinent evidence is collected, would it be a bad idea to leave a bottle of pills in the the prisoners jail cell?

An American judge known for his harsh and autocratic courtroom manner was jailed for 28 years for conspiring with private prisons to hand young offenders maximum sentences in return for kickbacks amounting to millions of dollars.

Mark Ciavarella Jnr was ordered to pay $1.2m (£770,000) in restitution after he was found to be a “figurehead” in the conspiracy that saw thousands of children unjustly punished in the name of profit in the case that became known as “kids for cash”.

The Pennsylvania Supreme Court has overturned some 4,000 convictions issued by the former Luzerne County judge between 2003 and 2008, claiming he violated the constitutional rights of the juveniles – including the right to legal counsel and the right to intelligently enter a plea. Ciavarella Jnr, 61, was tried and convicted of racketeering charges earlier this year but his lawyers had asked for a “reasonable” sentence, claiming that he had already been punished enough.

A natural consequence of the private prison industry. This judge, and how many others? The criminal justice system in our country needs serious reform.

He had a duty to uphold the rights of suspects and the Constitution, and he did neither. He abused his sacred trust, for money. IMO 28 years is too little for scum like this.

You want to see the horrible story have a happy ending. You want to see good Americans like Ramsey be recognized. There is so much pure **** in the news these days. Politicians and corporate heads and others like them are self-serving assholes of the highest order. Ramsey is more like the American I want the world to see. Ramsey is a great example of what Americans are. We just rarely hear from or about real Americans.
All the best to all the 3 women and the little girl. All the best to Chuck Ramsey.
