Hell, they tried to give me a DUI for sitting in my truck with the heat one while waiting for a cab to come get me. It was 15 friggin degrees outside and in Alaska, the cabs aren't exactly fast getting there. The cab pulled up as he was giving me a road side test where I was required to stand on one leg on ice.

I can't imagine what would have happened if the DUI had stuck. I hear it's a bitch.

No, it's quite common and I'm surprised that you got away with it. It usually doesn't matter, they can give you a DUI if you are in your car and drunk. Even if you have friends coming. I've known a few people who got DUIs that way. It's because the DUI is demonized in order to excuse these sorts of draconian methods against our own people so that the government can take more of our money. In the end, that's what it's all about; not safety, not some public service or good, but extorting more money out of us. The DUI laws are ridiculous, but they'll always be ready with some sob story if someone dare questions them on it. It's a money making scam and nothing more.

I didn't completely get away with it. I went down to a lesser charge, paid a fine, and had to go to some class where they acted as if I was an alcoholic for 12 hours (3 four hour sessions).

I told the DA, outright, that if he was going to try to make the DUI stick that I was prepared with phone records of my call to the cab, the cab driver's sworn affadavit that he came to pick me up and was turned away by the cop, and the weather report for that night that said it was 15 degrees. Also, the owner of Chilkoot's (the bar where I was) was prepared to come and state that he had to alter his 2AM policy of kicking everyone out the doors immediately during winter hours because he felt he was to blame for my DUI. (He happened to be one of my clients at the company I worked for there).

The DA, I guess, didn't want a trial and that's where it was headed. After some discussion with the judge, they came back with an offer that avoided the DUI and losing my license, got the fine cut down to less than $500.00, and avoided the jail time. Also, the city released my truck to me with no charges. They could have kept it impounded for 90 days otherwise.

No, it was reckless endangerment or something like that. It cost me 8 points on my license but stopped just shy of suspending it. In retrospect, I should have just fought the DUI in front of a jury of 6 and taken my chances.

The whole deal still cost me close to $7000 if you count the increased insurance for 5 years.

This is the BS crap that's been going on in our government for FAR too long. People want to think "drunk drivers are evil and blah blah blah, throw the book at them!" But this is the result of it. Innocent people get caught up, people who may be driving ok are getting caught up. Surely you can't let drunk driving be legal; but we've allowed ourselves to become so rabid about it that we've lost all sense. Now even fighting the DUI costs a lot of money and they can just issue one without you actually drunk driving. There's an operable word in there...it's driving! You can't drunk drive without driving (well or being drunk). I think if you are driving drunk, fine. But you can't be taken in for just being in your car; but they'll get you. Even if you're sleeping in the back...BOOM DUI. And then all the checkpoints, those are bull**** things too! At this point, I'd rather live with the drunk driving than the government enforcing the law.

It's political suicide to tell mommies that their babies' deaths were tragic but there's going to be no move to restrict others and all out social war gets waged.

MADD has also been slowly pushing down the legal BAC over the years, too. It's down to .06 in some places now. That's about half a beer for someone my size, I think.

DWAI is 0.05. It's a "baby" DUI; but carries all the same penalties and fines as a regular DUI.
