Mark Steyn Tries (again) to Push the Mann Trial Forward

Please keep in mind that Steyn was not a party to the motion to dismiss, and at trial he is absolutely free to assert the truth of the claim that MM "tortured" the data.

But it wont be by Mann's testimony. Steyn supposedly would have had that evidence BEFORE he made the claim, and thats what he can present.

And virtually every normal thinking person would laugh and dismiss it as rubbish, much like virtually every politicallly motivated investigation into his work has done again and again.

You seem to be confused about the concept of 'discovery' in a civil case. There will not be 'discovery' on Mann - because it would be a tremendous waste of money by the defense. Because Steyn et al cant create NEW evidence of fraud - you cant do a fishing expedition to retroactively prove your claims (unless you're Congress).

That's why he wrote his book: to get MM's colleagues on the record.

Steyn is being sued for writing a blog insulting Mann. This is the very definition of frivolous and a waste of money and time for the justice system. It doesnt matter if its defaming, as such laws are a violation of free speech in the first place. You might as well sue every single person on this forum who has said much worse.

I disagree.

We don't have the freedom to write any lies about anybody. You get sued.

I would like to see a law that had it that if you lied (knowingly) and called it science you went to jail.

It would be a shock to the system for many in journalism but that would not make them half as responsible as a gas fitter who is responsible for all the appliances in a house after he has worked there, even the ones he did not even see.

Cause Mann will lose this case so... moot point

As Greg Laden points out, his track record so far is 6/6.

"This is the sixth out of six decisions that have come down in favor of science: Cuccinelli v. UVA/Mann, Cuccinelli v. UVA/Mann supreme Court Appeal, ATI v. UVA/Mann, ATI v. UVA/Mann Supreme Court Appeal, Mann v. CEI/NRO/etc DC District Court, Mann v. CEI/NRO DC Appeals Court."

Mann could drop the suit tomorrow, if he wished, although I'm sure you have some alternate reality explanation for that too...

MM can't drop the suit without opening himself up to cat-calls everywhere. He's trapped himself.

So your logic is that rather than facing cat calls when losing the suit, he's afraid to drop it because he'll face cat calls?

Brilliant.

Did I read that right?

ORDERED and ADJUDGED that the trial court’s denial of the special motions
to dismiss the defamation claims is affirmed, and the matter is remanded
for additional proceedings in the trial court with respect to these claims.

It's quite clear to me, but who knows what you think you read.

Congratulations on getting to page 1. Only 110 more pages for you to 'read'.

I don't care enough to read all of it. It just seems nothing has changed. The trial Stein wants to move forward is still occurring, right?

Of course you don't care enough to read it all. But you'll still give your uninformed opinions about it, right?

Anyone who seriously believes Steyn 'wants' this case to move forward, would have to be an even bigger fool than Steyn is.

I don't need to read what I have been aware of before.

Have yo even seen my opinion?

I think you are over reacting to my comments, in a knee-jerk fashion.

I have a wait and see approach.

He could but that would be a clear admission that he has lost. Everybody would be OK to call him a manipulator of data. That he is dishonest. Difficult for him to justify all the expense he has so far incured in his case surely?

This whole situation is funny to watch.

You have nicely captured MM's dilemma. He's now in a no-win position of his own making. That's why he's happy with delay.

WHy are you typing in blue?

It's so I can scan the thread and see where I last read it easily. And I like to be different. And I think it makes the discussion flow better when you are instantly aware that this is somebody else speaking.
