US State Makes It Illegal To Collect Evidence Of Pollution On Public Property

So is you suspect a landowner is polluting, you have to get their permission from them to take a sample to prove if they are polluting? That'll work.
Turn over the evidence you have, and give it to the right officials. they have the legal means to get a search warrant.

Suspicion is not grounds to violate someone elses property. You have to have probable cause.
 
This is a mischaracterization.

The bill addresses the collection of evidence on public lands. Says so right in the title & then further in the article.

And this includes pictures! So $5K fine for taking pictures on public lands? :doh

The bill says nothing about public land either.
 
It actually goes much further than that. If you took only pictures and left only footprints then you could still be conditionally prosecuted for trespass on public lands.

Please show me in the bill where it says that.
 
Since when did a simple photograph become "resource data"? The problem becomes one of eventual use and is not limited to original intent. If my published (transferred or donated) picture is later used by someone else as "resource data" does that make my initial action (simply taking a picture) trespassing?

Read the bill, it specifically states that the purpose of the visit, not the visit itself makes the act trespassing. There already is a law against physical trespassing - this is new bill intended to make "resource collection" a crime (of trespassing).

True. I have a habit of responding to posts before i read all after it.

Just the same, from the very first post, I saw the inaccuracy of the OP.

I really wish people would have the wisdom to verify before striking on the keyboard.
