I know a guy who spit on an officer while he was visiting California.
They held him in jail while waiting for the results of his HIV test.
Had he been positive, he would've been charged with attempted homicide.
This was in... oh, 1994, probably.

Ya, the difference is that in your example, it was highly unlikely for the bullet to strike someone, but it DID. And in the case here, it's highly unlikely to infect someone with HIV from saliva...and it DIDN'T.

HIV lives in the blood. Your mouth uses blood. Given that many things can cause open wounds in one's mouth (chewing, sores, bad hygiene, flossing) it is very likely blood enters the mouth and mixes with saliva quite often. From what I read it is "difficult" to get HIV, even from blood but under certain circumstances (as Rivrat said) its not impossible. Same goes for sitting on a toilet or shaking hands, etc. Its never IMPOSSIBLE just really really unlikely.

It's unlikely enough to make it impossible for all intents and purposes. Just like when people say that abstinence is a 100% effective way to not get pregnant. Well, no, technically it ISN'T 100% effective. But it's close enough to make arguing about it a little silly.

Anyone who is actually worried that the guy might've gotten HIV is being completely irrational. Would you also have wanted the guy charged with attempted murder if he sat on a toilet seat before the cop did, or shook the cop's hand, with the intention of giving him HIV? I'm hard-pressed to find any distinction between this case and those examples, other than that saliva SEEMS like it could be a form of transmission to those who don't really know better.
