Okay. I'll play. Just so you can make me look foolish. Ha!

The second one because it has a scope. No. I'm going to change my mind. Scopes are useful for hunting. I'm going to say neither one because it doesn't look like either one holds lots of rounds. (Am I close??? I'm CURIOUS now....)
The devil whispered in my ear, "You cannot withstand the storm." I whispered back, "I am the storm."

The media has a tendency to call all semi-auto guns "assault weapons". This is a misnomer.

An assault weapon is a selective fire rifle or carbine, capable of firing bursts or full-auto. These are already banned except for those holding Class III Federal firearms licenses... which are not that easy to get.

Also, full-auto weapons are so rarely used in crime that they are almost a non-issue for law enforcement.

Actually they both at one time were considered an "assault weapon".... that my friend is a Marlin .22, both of them. its a .22 caliber rifle that is often the first rifle folks use. One has a different stock on it..... that's it.

The Rev appears to have wandered off, so if you don't mind I'll answer.

Those are both the same gun. The bottom one has a different stock, and a scope.

Neither is properly an "assault weapon", but under some definitions (mis-definitions) the bottom one would be banned for having a pistol-grip stock.

Neither is capable of full-auto fire. Both have 15+ round capacity in the tubular magazine under the stock. Both are .22 rifles, a very light caliber... the sort of thing you hunt squirrels with, or give to your 12yo as a "first gun".

Part of the problem is the term "assault weapons" has been so misused and DELIBERATELY abused in the gun-control debate that the word has lost all meaning.

Pretty damn pathetic that people wanna blame the guns for the persons actions. He could have used any number of methods to do what he wanted to do.

I mean for gods sake he could have used the spanner in the billiards room, but no, he chose to use a gun.

And now, tragic death is once again being used as a political tool to try and control something that, really, did not cause those deaths, the person behind that weapon caused those deaths.

Hate to be captain Obvious here but, I guess some people need that.

You hit on it --- it's Obvious to you and me but to others it's not obvious at all. There's a long and robust history as you know, of blaming guns and not people in this country.
I think if Thomas Jefferson were looking down, the author of the Bill of Rights, on whats being proposed here, hed agree with it. He would agree that the First Amendment cannot be absolute. - Chuck Schumer (D). Yet, Madison and Mason wrote the Bill of Rights, according to Sheila Jackson Lee, 400 years ago. Yup, it's a fact.

I can't see if there's a selector switch saying "full auto", so I have no way to tell if both or neither are properly "assault" rifles.

I doubt the M1 would qualify, as technically "assault" rifles usually use intermediate cartridges while the M1 is usually 30-06 caliber.
