    Congressional Research Service memo raises fresh constitutional questions about Obama

    Specifically, the CRS memo says the health-care law may be unconstitutional under the Tenth Amendment under two legal doctrines the Supreme Court has developed under that constitutional amendment: the “commandeering” doctrine and intergovernmental tax immunity.

    The Tenth Amendment says: “Powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.”
    HA HA HA HA HA HA HA, looks like the law might just defeat itself.

    All well and good, but I still want to know what part of the Constitution gives the Fed. the authority to require me to buy any product from any company.

    That I think is the bottom line. (and please, don't anyone start that foolishness about car insurance.... that is voluntary)

    There is none, if anything they could try to weasel it through the 10th Amendment.

    This varies by state, in NY its required to get liability at the bare minimum. If you take out a car loan for said vehicle the bank makes you get full coverage.

    So let's say this challenge pans out, does that overturn the whole law or just the applicable provisions?

    Since the questioned provisions are revenue-related, it also seems like Congress could preemptively fix it through reconciliation.

    edit: for the conservatives calling the Oklahoma judge's blocking of the abortion bill "activist," would this also qualify as activist judges if it went down this way?

    Rhetorical questions are generally bad ideas in debating. They give your opponents the power. They can just deflect the issue with a joke or use it as an opportunity to make an unrelated moral or political point.
