Norfolk judge orders anti-Burfoot website taken down | HamptonRoads.com | PilotOnline.com

"A judge Wednesday forced the removal of a website attacking Vice Mayor Anthony Burfoot and the city's treatment of downtown clubs.

Circuit Court Judge Charles E. Poston ordered an immediate removal of the website May4thCounts.com, stating that other legal action "is not adequate under the particular circumstances of this case."

GoDaddy.com, the site's host, removed the content later in the day.

The website appeared last week, about a month before City Council elections. Burfoot, a target of the website, brought the suit in Circuit Court."

This is my hometown. I am ashamed of it. Talk about suppression of free speech combined with ugly politics! This story should go national soon.

City municipalities have decided to follow the socialistic leanings of the Obama regime.

Please tell us what part of socialist theory involves clamping down on free speech? Last I checked this was pretty common regardless of political leaning. You know what? Why don't you just do us all a favor and drive your bike on one of those streets built by socialism?

Aw, come on now bike. I know you are a lot smarter than that.:(

There are some serious issues involved here.

I did not know, for example that a lowly city circuit court judge could shut down an internet site for no valid reasons that I can see.

I can't wait to see how this plays out. It is going to be a huge can of worms about corrupt government. If they be liberal democrats who are guilty, amen.,

It was the Bush regime who set up the "free speech zones." It was also during the Bush regime that it was determined we have a 200-mile wide "Constitution-free zone" strip from our borders.

You and I are in agreement here, LA, but you have to admit it. These city municipalities are getting on the band wagon and following in Obama's footsteps. I know you are an Obama fan, yet you are incensed at the Courts stepping on freedom of speech. I predict come next election, you will be voting Republican straight through. Now, back to Burfoot. I don't live in this city, but exactly who does Burfoot think he is and why does he think he has the right to sue a citizen for questioning his ability to lead? It has been a long time rumor that the Norfolk City Council is one crooked machine. Looks like they have the Courts in their back pockets as well.

What street would that be?

Free speech zones were used before the bush Administration. Bush's secret service guys just expanded on the idea.

[ame="http://en.wikipedia.org/wiki/Free_speech_zone"]free speech zones[/ame]

The most prominent examples were those created by the United States Secret Service for President George W. Bush and other members of his administration.[3] Free speech zones existed in limited forms prior to the Presidency of George W. Bush; it was during Bush's presidency that their scope has been greatly expanded.

The term "constitution free zone" was new to me. It seems to refer to the area near the border where people are stopped at random in a way that should be unconstitutional. It seems quite a few of us live in Constitution free zones.

constitution free zones;

# Normally under the Fourth Amendment of the U.S. Constitution, the American people are not generally subject to random and arbitrary stops and searches.
# The border, however, has always been an exception. There, the longstanding view is that the normal rules do not apply. For example the authorities do not need a warrant or probable cause to conduct a “routine search.”

Socialist is the new liberal. It means anything bad.

Please, for once in your life, back up your preposterous claims about Obama with real facts. And then when you're wrong, admit it and learn from it and think next time. How has Obama clamped down on free speech?

It was a libel thing. Apparently he proved to the judge it was libelous. Surprising, as he's a public figure.

And Progressive is the new Socialist. Every few decades it changes and reverts.

Would the revival of the Fairness Doctrine stir some thought processes in that little head of yours? What regime constantly berates conservative talk radio and TV? What regime hints at bringing back the Fairness Doctrine when you know quite well fairness is the furthest from the agenda? Think, little one.
Who wants to kill conservative talk shows because he claims that blacks, Hispanics, and women are not represented by talk radio?

What about Obama's new FCC Czar, Mark Lloyd? It seems he wants to make private broadcasting companies pay licensing fees up to an amount equal to their total operating costs to fund Public Broadcasting. The fee that these broadcasters would pay would vary based on the station's programming of “diverse views” and government activities. In other words, no all-conservative talk radio. This anti-free speech should be sinking in about now MM.

UPDATE:

NORFOLK (AP) -- A day after ordering a Website shut down, the same Norfolk judge has now vacated that order, WVEC.com has learned.

Judge Charles E. Poston vacated his order late Thursday afternoon that removed May4thCounts.com from its host website, GoDaddy.com.

Read the decision: Judge vacates order that shut down Website critical of Norfolk vice mayor | 13NEWS / WVEC.com | Hampton Roads News, Breaking News | wvec.com | News for Hampton Roads, Virginia

I think that Judge is one of the elected type judges and could be facing a re-election hurdle.

Burfoot wants to sue the website author for slander. That shows how dumb the Vice Mayor is. He doesn't even know the difference between slander and libel. Norfolk gets what it votes for. I wonder if he plans to sue his political opponent when his opponent blasts him for his lack of leadership skills?

How could he prove libel? He wants to sue the guy for slander. It's obvious he doesn't know the difference between the two. A decent judge should throw his case and him out on his rear.

I seldom vote for a republican. The last republican I voted for, was my wife's employer.

I am not really a liberal. I am an extreme centrist, though. I don't care who they are or what party they belong to. It is a non partisan issue for me. It is about free speech and crooked politicians.

This country is in no mood for the crooks.

Dittohead not! did the research on those. Thanks. And here's a graphic showing exactly where the Constitution-free zones are.

If anybody read the comments at the end of the article you will notice that the people were really pissed at the judge.

The judge even admitted in his vacating order that the virginia constitution would not hold up his decision.

How about how Bush used the FCC to censor content instead of being a regulatory agency? After Janet Jackson's nipple slip at the Super Bowl, any old lady who called in and complained about anything they didn't like on tv could get those affiliate stations fined big bucks for airing something "offensive" to anyone. That's just as much anti-free speech as the Fairness Doctrine is.

Besides, I wouldn't mind it if we had more money for better Public Broadcasting. However, I'd want more educational shows for children and teenagers. The only thing on tv for them to watch are cartoons that just want to sell toys and commercials.

This should help put your mind at ease regarding the so called "fairness doctrine."

As the president stated during the campaign, he does not believe the Fairness Doctrine should be reinstated," White House spokesman Ben LaBolt told FOXNews.com.

As for that "Constitution free zone", now that's right up there with the Patriot Act and asset forfeiture on the list of attacks on basic liberties. I'm not sure how we can support the idea of a "free speech zone" either. I thought he whole country was a free speech zone.
