    Idaho Gov. C.L. "Butch" Otter said Monday that he and other Republican governors are already meeting today -- just hours after Congress passed a $940 billion health care reform plan -- to discuss how they can repeal the legislation.

    "If Congress goes ahead with this financial and economic insanity, which is unconstitutional, then we'll sue," Mr. Otter told The Washington Times' "America's Morning News" radio show.

    And we all know what is going to happen

    The lawsuits will fail, and the state governments will complain and refuse to take part, the federal government will withhold money for medicare, medicaid and the new program. The states will capitulate as they will want the money

    Here is why this will be shot down by the Supreme Court, if a miracle happens and it even gets that far:

    Helvering v. Davis, which, in 1937, ruled that the Social Security Act was Constitutional.

    It is a fascinating case. You can read about it here.

    The authority of the Federal government to turn something as repugnant as this health care bill into law is based on settled law, and the Supremes won't touch it. As a matter of fact, they would see this as a frivolous lawsuit. So would the lower courts. Any lawsuit in this area doesn't stand a chance. All you can do now is bend over and take it, while voting to unseat those in Congress who supported it.

    I note that Obama's job approval rating is at 50%. Better than Reagan and Carter and within polling accuracy points of Clinton and Nixon at the same point in their presidency.

    Dubya was way ahead, but that was just 6 months after 9/11.

    To read DP on this subject as a foreigner, you'd be led to believe that Obama was the most reviled President in history and that his every initiative was less popular than Swine Flu. How come the polls don't reflect this? It appears the country is in favour of the passing of the bill...
