I don't see much in the way of support for this claim. Many states, perhaps as many as 38 had introduced legislation which would have challenged the health care reform, but many of those proposals have already failed or have been restricted to committee. It's also very unlikely that California is going to pass anything that would challenge the reform even though it appears to be counted among the 38.
Idaho and Virgina have passed state laws and Arizona has passed a law which will put the question on the ballot in November to amend the state constitution, and Missouri is half way there, Utah may or may not comply, but that is the extent to which states are changing their laws to challenge the federal health care reform. 3 and 1/2 states is not 38, no matter how much you want to sensationalize it. Now when 30 or so states have changed their laws to challenge health care reform, you might have something to talk about, but just because Republican lawmakers in 38 states have introduced legislation to challenge it does not mean the state has or will change its law.
