Get enough States together and they can change the Constitution (Amendment) to outlaw Federal Mandated Health Insurance.

    Article V - Amendment Note1 - Note2 - Note3
The Congress, whenever two thirds of both Houses shall deem it necessary, shall propose Amendments to this Constitution, or, on the Application of the Legislatures of two thirds of the several States, shall call a Convention for proposing Amendments, which, in either Case, shall be valid to all Intents and Purposes, as part of this Constitution, when ratified by the Legislatures of three fourths of the several States, or by Conventions in three fourths thereof, as the one or the other Mode of Ratification may be proposed by the Congress; Provided that no Amendment which may be made prior to the Year One thousand eight hundred and eight shall in any Manner affect the first and fourth Clauses in the Ninth Section of the first Article; and that no State, without its Consent, shall be deprived of its equal Suffrage in the Senate.

Oops.......... 38 states are already changing their laws to make this POS illegal.

The governor of Idaho signed a bill last week blocking federal mandates requiring individuals in his state to purchase health insurance.

Some 38 states have either filed or announced their intention to file similar legislation, according to the American Legislative Exchange Council, which opposes the health reform bill.

    So lets do the Math!!!!!!!!

2/3rd's of 50 States looks to me to be 33 and a third States....... that's less than 38!

3/4's of 50 States looks like 37 and a half States...... that's also less than 38 States.

Any one here still think the States will be defeated in their bid to out law this POS?

We have seen this all before. When one group thinks their will should prevail over others objections, whether they like it or not. It seldom ends well. I like a round table discussion myself. with equal parties, and no King.

Even Texas had best learn when it is beaten.

As others have said, this lawsuit will go nowhere.

It is a waste of time and money even attempting such.

It is in reality simply Politico's in Tx attempting to inform the unwashed masses of Tx that they are doing something, whereas in fact, as normal they are doing diddly squat.

Dubya was way ahead, but that was just 6 months after 9/11.

To read DP on this subject as a foreigner, you'd be led to believe that Obama was the most reviled President in history and that his every initiative was less popular than Swine Flu. How come the polls don't reflect this? It appears the country is in favour of the passing of the bill...

What it ultimately boils down to is will Texas forgo Medicaid and medicare payments from the Federal Gov.?

Taken that the Gubernatorial election is just around the corner and that Texas has an enormous number of retirees, no I think you will find that this little push back against Federal Gov. will not amount to a hill of beans.

Texas also reserves the right of secession, which would make sense if the federal government wants socialism rather than freedom. I can see why Texas might want freedom...
