Obama constitutionally barred from accepting Nobel Peace Prize

My understanding of the Nobel prize is that it consists of two parts:

1) A trinket which is admittedly an excellent conversation piece

2) A bucket of money

Obama has already said he's giving away the bucket of money.

Unless someone can actually demonstrate that the prize in and of itself is intrinsically worth something (beyond what some loopy-ass collector or eBay nut would pay for it), this is neither illegal nor unConstitutional.

As for Czars, STFU and write your Congresscritters. They're the ones who keep empowering the President to appoint people to "extraConstitutional" positions of authority.

People can, and undoubtedly will, argue for some time about whether President Obama deserves the Nobel Peace Prize. Meanwhile, though, there's a simpler and more immediate question: Does the Constitution allow him to accept the award?

Article I, Section 9, of the Constitution, the emolument clause, clearly stipulates: "And no Person holding any Office of Profit or Trust under them, shall, without the Consent of the Congress, accept of any present, Emolument, Office, or Title, of any kind whatever, from any King, Prince or foreign State."

yet the inNobel prize is not from a STATE it is from a "committee" the Nobel Committee!! Yes the committee is apppointed by a bunch of foreigners !! This one could be argued either way. So if the Obamer wants to get this monkey prize off his back he can have his constitutional law advisor interpret the InNobel committee as a unit of or a agent of a foreign government and theebt ecline the prize.

That would be the start thing to do after doing the dumb thing and saying thanks I'll take it !!

Part III, Subpart F, Chapter 73, Subchapter IV,


§ 7342. Receipt and disposition of foreign gifts and decorations(a) For the purpose of this section—
(2) “foreign government” means—
(A) any unit of foreign governmental authority, including any foreign national, State, local, and municipal government;
(B) any international or multinational organization whose membership is composed of any unit of foreign government described in subparagraph (A); and
(C) any agent or representative of any such unit or such organization, while acting as such;​
"The Norwegian Parliament appoints the Norwegian Nobel Committee", seems to qualify.
 
Which is stupid. Who cares who some committee chooses to give a prize to, and how exactly is it Obama's fault. I generally support Obama, thought the prize going to him was stupid, and that was the end of it to my mind. It's a handful of people who just want to make a big deal over nothing.

It's a little more than a mere handful of people, it's a handful of people that want to influence our politics with this prize. They clearly told the world that was their intent.

I say they go off together and pull each other's prize.

Congress should vote to deny Obama from traveling to accept the award... Sending a message to the Nobel committee to stay the **** away from our politics...
otherwise these Eurosocialists will do it again and again.

Stick to giving it to retired failures like Carter or Algore... terrorists and UN agencies... but leave our active failures alone. They don't need encouragement, and it smacks of Affirmative Action. Like the Obamer can't get anything done himself.

Does anyone know how this dub got into Harvard with his grades? I don;t think the press ever asked.

I do not think Obama,AL Gore, Yasser Arafat or some of the other individuals did not deserve the nobel peace prize. But I do not think there is anything to stop Obama from accepting it if he really wants to accept it. The Nobel peace prize committee is not a King, Prince or foreign State. They are a private group. If one of those inbred people in Britain known as the Queen wanted to knight Obama or give Obama a present while he was still in office then that would be a different story.

I'm proud my president won the Nobel Peace Prize. I'm not sure why any of you want to "prove" this wrong or find an out for him to be denied. It's ridiculous.

I would be proud he won it, if he deserved it. Given the nature of the award, I don't he has done anything to deserve such an honor.

It's not to say I don't think he has the capability of doing something to deserve of it, I just don't think he has done anything to deserve it at the time the nominations were given.

It is just not the Constitution that prohibits him, but U.S. Code also.

Um, actually, no. It doesn't.

The legal definition that you cited, would only apply if the Nobel Committee were composed of government officials. Appointed by government officials doesn't quality.
 
Obama, while having done absolutely nothing to warrant receiving the Nobel Peace Prize is not constitutionally barred from receiving it.

The constitution dictates that he can not receive an award from a King, Price, or foreign state. However, the Nobel committee is none of those things. And, while the King of Norway is in attendance at the ceremony, he does not present the award himself, nor is the award coming from him.

While the honorable thing to do would have been to gracefully turn down the prize, since Obama should (if he has any ethics or scruples) know that he has done nothing to deserve it, you know full well that his media-loving ego will force him to be on Air Force One and on his way to Oslo to get his undeserved prize in December.

Should he accept the prize? NO.
Can he accept the prize? Yes.
 
1) A president cannot accept an emolument.

2) Obama gave every penny to charity instead of accepting it.

Now, instead of continuing silly season, why not concentrate on the IMPORTANT issues, you know, like Obama bankrupting the country. Or would you rather hand the Democrats everything they want on a silver platter by ignoring the important and concentrating on the silly? But I can see that you are already doing that.

The once great and ruthless GOP has been reduced to this? Jeez, next thing you know, their idea of political battles will be telling fart jokes. :mrgreen:
