A Virginia school board hoping to block a transgender teen from using the boy's bathroom at his high school took its legal fight to the Supreme Court on Wednesday.
The move would mark the first time that the legal battle over whether transgender students can use bathrooms aligned with their gender identity has reached the nation's highest court.

Gloucester County School Board has suffered a number of legal setbacks — most recently Tuesday, when a federal appeals court said it wouldn't halt a lower court's ruling that ordered school officials to provide the teen with bathroom access. School officials wanted to put that preliminary ruling, issued last month, on hold while they ask the Supreme Court to review their case.

The school board filed an emergency application with SCOTUS, asking Chief Justice John Roberts to suspend the lower court's decision, Reuters reports. Five votes are needed to do so.

The school board has also said it plans to ask the Supreme Court to review the whole case. Legal experts have said that a full review is unlikely while the issue is being hashed out in lower courts — especially since circuit courts haven't split on the issue.

Well the Trans bathroom issue will now reach the SCOTUS for the first time in hopes to have a case involving the issue to be taken up by the Supreme Court. If the Supreme Court does decide to take up the case they will most likely not review the whole case involving a Virginia school board.

Teenagers are gonna be reading about this in their US Government classes decades from now.

I wonder what they'll say.......

"What in the **** were our parents/grand-parents thinking when oppressing this small minority? Trans people have been using the bathroom they themselves associate with their gender for many many many years before this became an "issue" in our history".

No, more like why is it even an issue, it's very clear who goes in which bathroom. They will probably laugh, as other countries probably are, that an issue like this is going before the Supreme Court. The left has really dragged this country down.

Hey bud, guess what? Trans people have been using the bathroom they themselves associate with their gender for many many many years.... This is an invented issue meant to distract us.

Of course it is. They want us caring about this garbage, and not focusing on our crushing debt, depleted military, lack of jobs, corrupt politicians, eic...

:lamo So you support laws that bar trans people using the bathroom they themselves have been using for years and years?

Society tends to become more progressive and inclusive as time goes by so I think we can guess.

I support that if you have a penis, you go to the men's room, and a vagina, you go to the ladies room. Very clear and simple.

So you're in favor of these new restriction laws, even though there have never been such laws in place?

Do I need to state the same thing over again?

So you are in fact in favor of making trans bathroom use a issue because you are in favor of initiating new policies that have never been in place before.

There are only two genders, and there is a bathroom for each one. That's not very hard to understand. This is all politicking on the Democrats part. They could not care less who gets to use which bathroom. But, if they think that they can stir up the pot and it will net them some votes, then they will jump in, caring only about votes, not people.

"Politicking". Its mostly the GOP who are bringing this up as a legitimate issue that needs addressing, thus making it an "issue".

So you are in fact of making something an issue that you just labeled as a distraction....

I don't know about labels, distractions, LGBTYTSXW rights. It's just a bathroom, we know who goes where. But the democrats are doing what they like to do. Make an issue, turn people against each other, and they want votes to save you from the awful people. And there are plenty of low information types for them to prey on.

They are not the ones bringing up policies to block people to go to the bathrooms. The Dems want to keep the status quo, while many Republicans want to change the status quo. When you attempt change the status quo you are attempting to create an issue.

So, for all our history, it's been okay for men to use the ladies room, and visa versa?

Has there been a problem with transgendered individuals using the bathroom they themselves associate with their gender?

Well actually it is. Privacy laws have been established for a while.
