More trouble for BO and employees using Private email. This one like Hillary and the Lois Lerner Emails and the IRS, is another example wherein BO's employee all of a sudden had his harddrive crash. To make matters worse. This guy.....fled the country. What say ye?




When a government official (think Hillary Clinton) uses a private email account for government work (think Hillary Clinton) and then doesn’t turn over records (think Hillary Clinton), the public has to wonder why. For an example of that why, consider Thursday’s federal-court subpoena of Phillip North. The North story hasn’t gotten a lot of attention, but it is a useful tale for clarifying exactly why we have federal records and sunshine laws. You see, government workers don’t use private email because it is “convenient.” They use private email to engage in practices that may be unsavory, or embarrassing, or even illegal. Let’s be clear about that.

The EPA would ultimately claim that it acted “in response to petitions” filed against the mine in 2010 by Native American tribes. But those petitions didn’t spring from nowhere. According to documents Pebble has given a federal court, Mr. North was working with those outside activists to engineer the petitions—from inside the EPA. He also worked with the activists, including a lawyer representing the tribes, to hone the EPA’s veto strategy. And he did this via a private email address. Why? Because he shouldn’t have been doing any of it.

It gets weirder, in that Mr. North was one of those Obama employees whose government hard drives conveniently crashed. Only after Congress started investigating the Pebble scandal did the EPA inform lawmakers that Mr. North’s crash just happened to wipe out documents from the period in question.....snip~

The EPA has acknowledged the email problem, telling the National Archives in early August that the EPA Inspector General had informed it of at least “five instances where [Phil North] used a personal, non-EPA email” to do government business with “a third party and failed to forward such emails into Agency systems.” The EPA continued that it “cannot confirm whether or not these emails are the only instances.” Separately, the agency admitted that it has been unable to access documents that were created and encrypted by Mr. North on a thumb drive.

On Thursday in Anchorage, Alaska, U.S. District Judge H. Russel Holland strongly disagreed—noting that Mr. North “appears to be at the center of Pebble’s claims that EPA impermissibly” worked with outside groups, and that he is the “originator of documents likely related to the claims” held on “private computer equipment.” He issued the subpoena, dryly noting: “Mr. North’s personal appearance is necessary. Indeed, the court would be surprised if the EPA were not as anxious as Pebble to obtain testimony and access to documents controlled by Mr. North.”

Judge Holland, consider yourself surprised. The EPA isn’t anxious for Mr. North to appear, any more than the State Department is anxious for the FBI to scour Hillary Clinton’s server. Those agencies know exactly why their employees use private email. And they know the release of it means nothing but trouble.....snip~ same link.

You know darn well that should a Republican administration come to office next, that the Democrats will be all over every email from everyone all the time (if they are smart).

Should the Democrats maintain the White House, the Republicans will be doing the same (if they are smart).

What effect is all this going to have on the actual process of trying to administer the government and it's affairs?

Well first, lets hope the States stand up and stop the expansion of the Feds powers.
 
What is it with agencies and emails all of a sudden? It's like a cascade effect.
First it was Lois Lerner/IRS, then it was Hillary/State Department and now this.

Corruption has exploded under this administration.

Using private emails to do gov't business is not accidential/incompetence. It's on purpose = corruption.

The use of private emails for government business is indeed purposeful, and appears to lead to corruption, at least for bureaucrats in the government.
 
This email BS is just the right wings way of getting revenge for the Bush administration using the RNC server for it's private emails during the build up to the Iraq War and the outing of a CIA agent and firing DAs who refused to engage in their political bs. I really don't recall many conservatives getting their panties in a wad over that.

I agree. I still think there is incompetence. It took over a year for Clinton's cabinet to get their clearances in the first year of his presidency. Obama's cabinet and appointments are the worst I have ever seen of any president since I have been alive for competence. It has been like a bunch of people doing on the job training. He refuses to fire any of them, regardless of how bad they screw up.

This Email BS.....is all on BO peep and those he brought with him. Thinking they could do whatever the hell they wanted to. How many different agencies has this BO peep BS really affected? Just how deep does it go? That's what needs to be addressed. So that all of BO's mopes can be outed and served up fresh to the American People.

As it stands now.....BO peep himself stated he was emailing Hillary on her private server. That would mean the dip**** is also just as incompetent as the rest of his Team are.

The very same crew which recently dumped three million gallons of toxic sludge out of an abandoned mine and turned the Animas River in Colorado the color of a yellow banded poison dart frog for roughly a week has just issued a whole new set of rules to “protect” small pools of water. They would also like you to know that these rules are going into effect even though a federal judge put them on hold in 13 states, too. This new batch of regulations is going to “protect” bodies of water which may include the ditch in front of your driveway or that persistent soggy patch in your back yard.

These rules were not suddenly rushed out in response to the agency’s own recent hijinks in an effort to make sure nobody else pulls such a boneheaded maneuver. They’ve been in the works for quite a while and a coalition of people ranging from farmers to landowners to states’ rights advocates have been howling about them. Though they are supposedly in place to prevent pollution in smaller tributary streams which feed into larger waterways, the rules are so broadly written that they could apply to virtually anyplace where water pools on the surface of the earth, leading to a permitting nightmare for the landowner if they want to do so much as landscape the area for drainage. The rules have been viewed as being so odius that the Farm Bureau started a massive push to trim them back down in scope.....snip~

I wonder what the judge is going to say about this. We don't know his intent and he could have meant actually for these 13 states. This could go many ways. The judge could amend his order if his intent was referring to the whole country and not to the states that were plaintiffs in the suit. If he did that it could mean he would be admitting that he screwed up by not including that statement in the injunction. He might not have had the legal ability to include all states as all states weren't in the suit.

This could push this one of the states in another suit to push for an emergency stay by the Supreme Court against EPA.

I agree partly. That one guy, can't remember his name, the old AG, not him, the other guy, oh yeah, Holder. He is a good example of an ass coverer. The AG now, Lynch, is another good example. I totally agree with the cover up issue. I also think they hired some real flakes that actually hosed up and didn't make the administration happy.

Obama wants sycophants, experience be damned. As long as they know how to "Yes sir" him every time, he doesn't care how inexperienced they are or how many questionable legal issues they have in the past...and he will defend them to the bitter end
