The U.S. Office of Special Counsel on Thursday announced a landmark determination that the Department of the Army engaged in “frequent, pervasive and humiliating,” gender-identity discrimination against Tamara Lusardi, a veteran and civilian Army software specialist who transitioned from male to female.Lusardi was working in the U.S. Army Aviation and Missile Research, Development and Engineering Center (“AMRDEC”) in Redstone, Ala., when she transitioned from male to female in 2010. During that time, the Army improperly restricted her restroom usage, referred to her with male pronouns and by her birth name and stopped giving her work, the OSC said in a report released Thursday.


In a telephone interview from Alabama, Lusardi, 49, who served in the Army from 1986 to 1993, including in Desert Storm, said she was called “sir” and “it” by co-workers and management after she legally changed her name, driver’s license and security clearance and began dressing as a woman.
Lusardi was also required to use a single-user, gender-neutral restroom, out of concerns that other employees might feel “uncomfortable” sharing a restroom with her.
The OSC, a federal investigative and prosecutorial agency, said that coworker preferences alone “cannot justify discriminatory working conditions,” since it could reinforce the very stereotypes and biases that nondiscrimination laws are intended to protect against. According to the report, Lusardi should be able to use bathrooms designated for her gender identity.

:applaud:applaudGood for her! I believe the OSC ruled in the right direction on this one. Another step in the right direction, and definitely a win for equality.

I feel sorry that female rights are now being tampled on. i don't see how this is a victory for them at all.
men are now allowed to use their bathrooms as long as they say they are female.

this is a sick country we are becoming no doubt about it.

You are confused? Just think about how confused, and otherwise ****ed up, someone like “Tamara” has to be to be so intent on pretending to be the opposite of his true sex.

People pretend to be what they are not all the time. How many times do we hear of preachers...men of god...screwing the congregation...both literally and figuratively.

The Church is full of liars and pretenders.
 
I have mixed feelings on the bathroom issue. Depends on her level of transitioning. Everything else is right on target. If she has changed her name, legally, they need to address her by THAT name.

Besides addressing her correctly, I don't see the issue. She was provided access to the uni-sex bathroom. South Park just did an episode on this and it was great.

Plus it's not like there is anything that would stop that pervert now from doing it. Do people really think a bunch of men are just going to start dressing up like women just to go into a women's restroom? Because I really don't.

It is the only "argument" they have.

I guess they figure if they can't go into the woman's restroom to ogle women...a transgendered woman should not be allow to.
 
This is an amazing show of homophobia gone wild.

I suppose the main players in this anti-T parade don't have significant others of the female variety in their lives, at least ones that use public restrooms.

While my list of accomplishments is rather modest I have managed to wed a female who has had to use several public (and Gubmint) restrooms. The 'worry' about a T following a woman into the restroom is odd.... my wife says each toilet is it's own restroom and no one can see a damn thing once the stall door is closed. (women don't have urinals for reasons obvious to those of us who have actually seen women naked.) Once outside the stall these people are as dressed and pass as close as in any corridor outside the bathroom.

To use the homophobes' 'logic' gay men are going into bathrooms to leer and make untoward advances while standing at the open urinals we penis equipped people are 'forced' to use... :roll:

Should we have a straight and gay bathroom division????

Or should a very few just stop projecting their fears on others and using women to justify their bigotry.... :peace

I've been advocating for bathrooms divided by usage rather than gender for a while now. One room for standing, one room for sitting, and a third on exit for washing up. Gendered bathrooms strike me as victorian inspired redundancies.

There are people born physically male but literally have different hormones and brain structures that are female. This isn't just someone being a "freak," as you guys hatefully refer to them so often. They aren't pretending. Sometimes their brain is literally structured like a woman's brain in certain areas.

It's a real medical issue, and your hatred doesn't help anyone.

OSHA regulations require that a business over a certain size have gender separated bathrooms.

I wonder if single-occupant restrooms technically meet the standard because they are inherently gender-separated. (and everything-else separated)
