Do you have some evidence that the DA is a religious holy roller type?

Because only the holy roller types would--gasp--enforce the law. This thread proves the Liberals lost the argument.

Just to point out, the statue was not damaged in any way. Therefore, it is different than vandalism.. there is monetary loss in vandalism.

The boy was trespassing.

What law did the teen break?
Section 5509 - Title 18 - CRIMES AND OFFENSES

In Pennsylvania, desecration, theft, or sale of "venerated objects" is a second degree misdemeanor -- with a maximum penalty of two years incarceration. The statute describes "desecrate" as "[d]efacing, damaging, polluting or otherwise physically mistreating in a way that the actor knows will outrage the sensibilities of persons likely to observe or discover the action." The statute applies specifically to objects like burial grounds and markers, but also to places of worship and public monuments.

The media likes to hype up the 2-years in jail thing, but that's the maximum for the most damage don to an object. Clearly this statue wasn't damaged, just "physically mistreated", and so I doubt the teen will get more than a handful of community service hours and maybe a token fine.

I dont know about 'liberals' in general, but what it DOES prove is how easily people here demonstrate their angry hate filled bigotry towards religious people.

Oh hells bells, if the statue was of Sméagol, are you saying the idiot teen would not have been up there as well?

It was an idiot teen. "Crime" of opportunity. The statue may very well have been a llama (4 legged or Dalai) and he might have been up there as well.

Good gracious, felony? If anything, just make him clean the bird**** off the statue and call it a day. And call his mommy.

'liberal' is more an ideological than political persuasion. I think its OK to point to those actually doing it as opposed to a blanket label.

Its kinda like the gun control argument. I work in a very liberal field. I know a lot of liberals. Out where I am even the liberals tend to own guns, even the very liberal lesbian types (not to be specific...just sayin...I shoot with a few and am married to one of thems sister). No need to duct tape a label on everyone...just point out the actions of the individuals.

Not even close to the point. The hatred and venom that spew out of the bigots here are not directed at a stupid law but at religious people. Shall we offer that same scorn and ridicule towards people that want to see EXTRA charges because some guys get their ******s hurt when an assault is perpetrated on a homosexual? Or for that matter when an assault by a black person is perpetrated against a white person and there is evidence that race was involved? The crime is "assault, not "assault".... and he made us all feel sad".

Its probably a fair bet to say YOU have your own issues. Does that mean you should neve work in a position of leadership or authority? Does that mean if you are the shift manager at Taco Bell (dare to dream baby) you cant write up one of your team for coming in habitually late because you yourself like to get off work, sit around in your underwear at home, smoke a joint and play video games or watch anime porn?

The DA may not be of the highest moral character.If so, then perhaps the good citizens in his county shouldnt keep electing him. THAT fact is NOT in any way shape or form relevant to the existing LAW that was broken by the moron teenager.

Why does it really matter? the guy can't win the case.

I find this kid disgusting but at the same time he does have First Amendment rights - something I highly doubt those opposed to my ideas would even think to acknowledging for me....

It almost seems as if you're proud of this young deviant....

Disorderly Conduct and or a lewd act in public would certainly stick....

Both are BS charges anyways but what the kid did was no different than vandalism.

The kid doesn't belong in jail - he should be scolded tho.

My concern is really about charging the kid with a felony. A stupid prank. Call his mommy and take away his cell phone.

If he harmed the statue, depending on the amount of damage, charge him in a way that befits the crime.

But it was a flipping cell phone prank. A "crime" of opportunity. Not a targeted hate crime intent on inflicting fear.

Have the kid clean all the bird poop off of the statue and call it a day.

I am not sure how you stop teen pranks. When they TP your house, is it a hate crime against the non-homeless?

Not a proud moment to be certain, but the statue could have easily been of an owl and he might have acted like an idiot on that one as well.

Well, Bill Higgins certainly has attracted his share of controversy.

If desecration of a statue is deemed a stupid law by Pennsylvania citizens, it should be changed, and maybe this case will spur such an initiative.

I don't think that the OP was making such an argument, though. ;)
