But it was a flipping cell phone prank. A "crime" of opportunity. Not a targeted hate crime intent on inflicting fear.

Have the kid clean all the bird poop off of the statue and call it a day.

I am not sure how you stop teen pranks. When they TP your house, is it a hate crime against the non-homeless?
The thread isn't about what the kid did.

My apologies. You are correct. Another poster on the related thread was speaking as if it should be a felony. Sorry about that.

Private property makes humping a tree in jest deviant act or a misdemeanor crime? Why would the DA treat it as anything other than a misdemeanor trespassing charge?

Remember that teen that pissed off a lot of lot of people because he posted a "bad image" with Jesus? Well it seems that the DA might of been a bit naughty too....

If the tree is a "venerated object", yes.

Explain the abuse of that object [venerated or not] by dry humping in jest. How is the venerated tree abused?

The venerated tree is not abused; your sensibilities are.

The venerated tree has no sensibilities. The venerated tree is not outraged that the venerated boulder just got dry humped in jest.

It has to be venerated for any of this to apply. Please stop moving the goal posts.

Using it in a manor other than intended with the intent to offend others.

And since no one has the right to abuse your sensibilities, a crime has thus been committed.

    No one said it did.

Objects don't have feelings. I'm happy you finally figured that out.
