My concern is really about charging the kid with a felony. A stupid prank. Call his mommy and take away his cell phone.

If he harmed the statue, depending on the amount of damage, charge him in a way that befits the crime.

But it was a flipping cell phone prank. A "crime" of opportunity. Not a targeted hate crime intent on inflicting fear.

Have the kid clean all the bird poop off of the statue and call it a day.

I am not sure how you stop teen pranks. When they TP your house, is it a hate crime against the non-homeless?

The thread isn't about what the kid did.

What if it's private property?

Private property makes humping a tree in jest deviant act or a misdemeanor crime? Why would the DA treat it as anything other than a misdemeanor trespassing charge?

The venerated tree is not abused; your sensibilities are.

The venerated tree has no sensibilities. The venerated tree is not outraged that the venerated boulder just got dry humped in jest.

It has to be venerated for any of this to apply. Please stop moving the goal posts.

And since no one has the right to abuse your sensibilities, a crime has thus been committed.

Damage does not have to be done - intent is the matter.

Nonsense. No physical damage, and the statue just doesn't care.
