And yet this conduct still broke the law.

Which is irrelevant to the fact that this was a religious statue. A venerated object could include a civil war canon or a statue of MLK.
 
DESECRATION OF VENERATED OBJECT

Any person who commits the offense of desecration of a venerated object is guilty of a crime.

For you to find the defendant guilty of this offense, the state must have proven beyond a reasonable doubt the existence of the following essential elements:1

[Part A:

(1) that the defendant desecrated a place of [worship] [burial];

and

(2) that the defendant acted intentionally.]

or

[Part B:

(1) that the defendant desecrated a [state] [national] flag;

and

(2) that the defendant acted intentionally.]

"Desecrate" means defacing, damaging, polluting or otherwise physically mistreating in a way that the person knows or should know will outrage the sensibilities of an ordinary individual likely to observe or discover the person's action.2

"Intentionally" means that a person acts intentionally with respect to the nature of the conduct or to a result of the conduct when it is the person's conscious objective or desire to engage in the conduct or cause the result.3

And after he gets out of jail he will go right back to the statue for the second coming.

Seriously. Yeah, the kid should not have done it. If it is an offense against God, and you believe in such things.....there will be judgment. But please, the fact that you think it should be a felony shows that you are looking to live in a theocracy. Wasting

I don't know why you're babbling about theocracy. Perhaps you don't know what you're talking about?

From the fact that some post pictures of Jesus, as an argument for why this 14-year old boy should be held for a crime, it is clear they believe that it's just fine for government to enforce religious laws. That is no different than imposing Sharia Law. The only difference is that Sharia Law is someone else's religion and the Christian Bible is their religion.

It is also clear that any law that makes it a crime to "desecrate" a religious object, when that object was not harmed in any way, fails two constitutional tests. 1) First Amendment: "Congress [government] shall make no law respecting an establishment of religion..." This law establishes Christian law (the desecration of an image of Jesus) as a crime.

2) Rooted in the Fifth and Fourteenth Amendments, is the tenet of "unconstitutional vagueness." That is, a statute might be voided for vagueness when an average citizen cannot generally determine what is being regulated or what the law applies. If a statue of Jesus is covered under the law but burning a Koran is not or a non-religious statue is not, then the law is unconstitutionally vague.
 
Unless you think lewdly posing with ANY statue (not just a religious one) should be a felony...yes...you are heading into theocracy territory.

The public's interest in not being offended by seeing naked people or hearing naughty words. There is no material harm from naked people or bad words.

The law is about a venerated object thus covering both religious and non religious. Therefore 1st amendment is not violated.

The issue of ownership also comes into play here. Had that been the boy's statue or at least his family's, then the law could not apply. I can go out and purchase my own Koran and burn it and no law in the US can touch me in and of itself. Incidentals, such as burning it on someone else's property or the act resulting in burn damage to property other than mine could be applied but those would apply regardless of what the initial object burned was.

Now I will admit that "venerated" can be a subjective term, which is why I do not like the law in and of itself.
