Any person who commits the offense of desecration of a venerated object is guilty of a crime.

It is also clear that any law that makes it a crime to "desecrate" a religious object, when that object was not harmed in any way, fails two constitutional tests. 1) First Amendment: "Congress [government] shall make no law respecting an establishment of religion..." This law establishes Christian law (the desecration of an image of Jesus) as a crime.
2) Rooted in the Fifth and Fourteenth Amendments, is the tenet of "unconstitutional vagueness." That is, a statute might be voided for vagueness when an average citizen cannot generally determine what is being regulated or what the law applies. If a statue of Jesus is covered under the law but burning a Koran is not or a non-religious statue is not, then the law is unconstitutionally vague.
