What good is a photo ID if one is in disguise?
 
I was at the NC DMV once when they made a woman go into the bathroom and remove her make-up (which looked like it was put on by spray paint) and to remove her wig before they would take her picture. In that context, I don't see a problem with it. The state of SC said they did this for the same reason when I read about this a couple days ago. I will give them the benefit of the doubt on this one, and not jump to a conclusion that this is some right wing religious thing or some anti-LGBT thing... unless evidence, real evidence, comes to light saying otherwise. At first, when I read the beginning of the article I read, they made it sound like it was some anti-LGBT thing, but buried way down in the article was the law that required the DMV to do it, so I took a second look and came to the new conclusion this is being fussed about simply because it IS in the state of SC, a red state, not because of what they did for the reason they did it... the law, which to me, makes sense. When you go to the DMV, you're not going to Glamor Shots to get a portrait taken.

The kid needs help, but as far as his license I don't care what he wears.

To me it seems totally off the wall. But truth be told, I hope SC loses.

Maybe, maybe not. I have no way to predict it. If the state can show where they have enforced this law before (like I know first hand the state of NC does) and not just on LBGT's, then the state of SC may have a pretty strong chance of prevailing in court. However, if they cannot show that they enforce the law across the board or that they do but only against LBGT's, then the state of SC is screwed.

Like you said, let's wait and see what happens.

I can see both sides on this really. On one hand an ID is supposed to identify who you REALLY are and with makeup and a wig it doesn't. However, if that is what you are normally wearing, then taking all that stuff off won't look like you then so what's the point?
 
The purpose of ID is???? Identification!! He can play dress up after he gets his photo taken. Find another cause to get behind because this isn't it, you just look irrational and quite frankly stupid.

They can't. They told him and the news that he was told he couldn't wear it because he is a guy, not for any other reason. Plus, his makeup was really conservative. You can barely tell he is male. Likely the main reason they knew was because of it being on his license.

The problem here is that he wasn't trying to alter his normal appearance. He normally wears makeup and looks like a girl. Just because the DMV doesn't know this doesn't mean he should be punished for them being naive on the fact that there are boys who wear makeup and dress like girls, even some who have no intention of actually switching their genders or sexes legally.

Heck, it would be more of a disguise for me to wear makeup than for him to, from what I've read. That is the major issue with this case. They would not make women/girls remove their makeup, because they assume that girls/women wear makeup. That is a major policy issue.

Then why did you just call him a "him" and not a her? The purpose of ID is not " who you present yourself as" its what you actually are and in HIS case its a male. So if I feel black I can wear face paint and a afro wig for my ID pic?? If the DMV noticed his makeup, then his makeup job sucks. The purpose of daily wear makeup is to obscure scars and bruising, not make it obvious that one is wearing makeup :rolleyes:

That comes as a huge surprise to me, I always thought that the purpose of makeup was to make it obvious that the person wearing it is a slut on the prowl.

Because he is not transgendered. He is gender nonconforming, meaning he does not uphold normal gender stereotypes, including what his gender normally wears, how his gender normally acts, and/or any other gender based standards people hold others to.

That doesn't make any sense. Anyone who wore makeup to portray him/herself as a slut is deceiving the public about his/her sluttiness. A true slut would not need to wear makeup.

To quote Yogi Berra, this seems like deja vu all over again. Didn't we have this discussion about 8 months ago?

Anyway, my position remains the same - if the government, the issuer of the privilege, believes you are in costume or disguise when getting your driver's license ID pic, they have the right to deny you the license. You should appear as natural as possible in such pics, in my view. A driver's license is not a right.

I personally think it's wrong to try to make this teen remove makeup, but if he is a "he", shouldn't his identification identify him as such? He is not a female, and his ID should reflect that fact.

They didn't even let me smile in my updated passport photo. Identification requirements are quirky things.

You fail in thinking that a male, a guy, a boy, a man is identified in whether or not he wears makeup or what kind of clothes or jewelry he wears. That has absolutely nothing to do with what makes a person male. Those are simply our societal/cultural norms for what each sex/gender normally wears or doesn't wear. It has absolutely nothing to do with what gender/sex they are or even consider themselves to be.
 
I think Roguenuke's position is kind of unassailable if unexpected. If a license's purpose is identification, and if the DMV believes that makeup impedes that aim, then it doesn't make sense for makeup to be acceptable for one gender and not the other.

On an unrelated note, why are some people so happy to sue? I've sued once, and it sucked. I would do everything to avoid that horrible experience again.

Um, excuse me? I never said that a male is identified by what he wears. A male is identified by virtue of his chromosome makeup.

They asked people to smile in the DMV just a couple of weeks ago when I went to get my learner's permit. They also didn't make me take off my glasses.

There wouldn't be an issue if everyone was made to remove their makeup, if no one could wear makeup for their photo. The issue comes from the fact that he was only asked to remove his makeup because his license identifies him as male. If he isn't going to be dressing like a "male" normally dresses while out on the rode, in public, driving, then there is no reason for him to fit the stereotypical male appearance for his license. It doesn't represent him.

It would be like asking me to wear makeup because someone can't tell that I'm "female".
