    Porch shooter: I didn't know gun was loaded

    DETROIT (AP) — A suburban Detroit man who killed an unarmed woman on his porch immediately suggested to police it was an accident and that he didn't know his shotgun was loaded, according to recorded remarks played in court Thursday.

    Theodore Wafer, dressed in jeans and a T-shirt, met officers outside his Dearborn Heights home after they responded to his 911 call around 4:30 a.m. on Nov. 2.

    "What happened here?" Sgt. Rory McManmon asked, according to the recording played by prosecutors.

    "A consistent knocking on the door, and I'm trying to look through the windows and the door," Wafer said. "It's banging somewhere else so I open up the door, kind of like who is this? And the gun discharged.

    The jury will hear the case. One of the judgments they will make is whether the shooting passes the reasonable man test.


    Based on the information WE have available (from the news, a notoriously unreliable source), it does not look reasonable. But what other information a jury may yet see, I cannot say. Thus I reserve judgment and decline to accept the notion that he MUST be found guilty or something is wrong.

    Apparently he now isn't even claiming a SYG defense. He claims that he didn't know his shotgun was loaded and when he aimed it at her face it discharged by itself.
    If he presents his defense as an accident he can't simultaneously claim castle doctrine. A self defense killing would require a non accidental purposeful shooting. His counsel seems to have given up on a castle doctrine, justified killing, defense.

    The latest now is that Wafer has dropped the accidental shooting defense and his lawyers opening statements suggest that he is now looking for a self defense plea.
    DETROIT, MI -- When 55-year-old Theodore Wafer of Deaborn Heights shot and killed 19-year-old Renisha McBride of Detroit on his front doorstep, he initially told police it was accidental.

    Wafer's defense team is now claiming self defense.

    Prosecutors on Thursday, the second day of testimony, presented dash-cam video and audio from Dearborn Heights Police Sgt. Rory McManmon, the first officer on the scene about 4:45 a.m. Nov. 2.

    "It's a little Mossberg (shotgun) you know, self-defense ... I opened the door and it's kind of like, who is this, and the gun discharged," Wafer is head saying. "I didn't know there was a round in there. I don't get it. Who's knocking on your door at 4:30 a.m., bang, bang, bang, somebody wanting in."

    Cheryl Carpenter, Wafer's lead attorney, never mentioned the firing of the weapon being accidental during her opening statements. Carpenter said Wafer pulled the trigger out of fear, that McBride was banging doors so hard it was shaking the house. Wafer, who was awoken from his slumber in a living room recliner, thought there were multiple people outside, couldn't find his cell phone and grabbed his shotgun.

    No. The case doesn't fit murder.
    The jury is going to wonder why she was two times over the legal limit 3½ hours later, and where she had been to get that way.
    And being that drunk, they will instinctively know she wasn't looking for any assistance.

    I'll agree with you that the fact that he may or may go to prison for what he did sends the right statement. But that girl is still dead and it's my guess that others will follow unless the laws change. Some states of SYG laws that don't have the same loopholes so they don't have the same problems. Why don't the states with poorly written SYG laws just follow lead of theses states

    SYG isn't really at issue here. This would be under Castle Law... and as I've said, I don't know of any state where you can simply shoot someone for being in your yard without some additional and reasonable indication of threat.

    That some idiots have misinterpreted the law, or more likely just did something stupid THEN tried to cover themselves with it, is not an indicator that the LAW is flawed.... more of an indicator that the PERSON who shot was where the screw up occurred.
