Homeowner Who Shot Dead A Teen Girl On His Porch Faces Murder Charges This Week

Bull****. If you're on my property, without my leave, you risk a high velocity chunk of lead penetrating vital organs at my discretion (and aim). You try to steal my property, you have said "My life is forfeit". You pound on my door in the middle of the night, and sound incoherent, don't follow directions? See point one. I'm not risking my life, property or family. This isn't the movies, happy endings aren't assured and there is no replacing a dead loved one because I worried about the other persons motives.

You do stupid ****, you get removed, forcibly from the gene pool.

And hopefully if you do most of this stupid stuff, we will stuff your ass into a cell and let you rot!

I've a friend from Fort Collins who has always said that Texans understand nothing about Mexican food and that you have to go to Colorado for the real thing. Let us know, Texmex.

Have fun, hope you like your auto insurance rates. Hehehe.

I live in Harris County, Texas. I doubt the insurance is more than I pay now.

Already addressed and you are wrong.
I understand your difficulty understanding the word "fact". But do try to learn so there is no more false claims made by you.
We are in the legal realm here. A fact is something said to be true.

Facts in evidence.
eg: She said she was raped by Tom.
That is a fact as would be admitted into evidence. It is something said to be true. It does not make it true.
But it is still a fact.

Wafer's statement is a fact, and has already been admitted as evidence.
Bullpucky.
That Wafer stated that his shotgun spontaneously discharged is a fact. The only fact at this point is that the statement was made and that Wafer made it.
That the gun actually spontaneously discharged is not a fact in the case until it can be proved to be true.
What is FACT?

A thing done; an action performed or an Incident transpiring; an event or circumstance; an actual occurrence. In the earlier days of the law “fact” was used almost exclusively in the sense of “action”or “deed;” but, although this usage survives, in some such phrases as “accessary before the fact,” it lias now acquired the broader meaning given above.A fact is either a state of things, that is, an existence, or a motion, that is, an event.1 Benth. Jud. Ev. 48.In the law of evidence. A circumstance, event or occurrence as it actually takes or took place; a physical object or appearance, as it actually exists or existed. An actual and absolute reality, as distinguished from mere supposition or opinion; a truth, as distinguished from fiction or error.

Law Dictionary: What is FACT? definition of FACT (Black's Law Dictionary)
Wafer's statement that the shotgun spontaniously discharged is a supposition or an opinion . NOT A FACT.
It is a fact that Wafer made a statement. It is not a fact that his statement was true either legally or figuratively.
You aren't a lawyer and your attempt to protect your lie with legalese is an utter and complete failure.
You seem to want to see white guys who murder unarmed black kids to go free. You have a substantial history of staunchly defending this type of murderer.
Now tell us why.

BLASPHAMY!

I'll let you know. I hope Mexican food is good in Colorado.

Bullpucky is right.
The above response just shows how wrong you were for assuming the word "fact" was used differently than it was.
And I seriously doubt you understand what you read in that truncated and unlinked explanation from 1910. Nor do you seem to understand specifically what it is speaking towards.

Your failure to understand that a "fact" is something said to be true, is your problem.

The previously provided example of the rape accusation should have sufficed, but because it didn't, try understanding the following.

Unless trial by Judge, the jury is the trier of fact. Do you not know what that means?
They are the trier of that which is said to be true.
Some of those facts have more weight than others.
And if not countered, they are undisputed facts.
The jury decides what is true amongst those provided facts.
They decide what facts they believe and disbelieve.

Please note that 4 & 5 apply to the legal field by example given and specificity of the definition.

fact
[fakt]
noun
1. something that actually exists; reality; truth: Your fears have no basis in fact.
2. something known to exist or to have happened: Space travel is now a fact.
3. a truth known by actual experience or observation; something known to be true: Scientists gather facts about plant growth.
4. something said to be true or supposed to have happened: The facts given by the witness are highly questionable.
5. Law. . Often, facts. an actual or alleged event or circumstance, as distinguished from its legal effect or consequence. Compare question of fact, question of law.

Wafer's statement that the shotgun spontaniously discharged is a supposition or an opinion . NOT A FACT.
Wrong.
His statement is evidence which has already been admitted.
Nor is his statement supposition. He is telling you what actually happened. It's a statement of an actual event. Not supposition. :lamo

So again; "Wafer's statement is a fact, and has already been admitted as evidence."

You aren't a lawyer and your attempt to protect your lie with legalese is an utter and complete failure.
You know not of what you speak.

You seem to want to see white guys who murder unarmed black kids to go free. You have a substantial history of staunchly defending this type of murderer.

:doh
Your delusions are yours to explain, not mine.
Especially as there was no murder here.

But the way the 2A is interpreted has changed over time and it's meaning is still hotly debated.

You actually believe for instance that a background check for private sales and sales at guns shows is a bad idea?
The only reason BGC on private sales is a bad idea is due to it being impossible to enforce without registration and registration is one of the last things people will agree to.

BLASPHAMY!

I'll let you know. I hope Mexican food is good in Colorado.

Apparently, Coloradoans think so.

In fact, my understanding is that the folks in Colorado consider their state superior to Texas in just about every way and don't generally like Texans much. Report back on this too please!

I understand their distrust. After all, we gave them George W. Bush. I believe I will fit in just fine. I'm not a wild-eyed conservative. I'm a liberal who will fit in good.

Homeless rates have shot up in Colorado.

Lots of losers who aspire at nothing more than to smoke weed have moved there recently.

Liberals have turnsd that place into a real hell hole.

Just the fact that you won't be there is enough for me.

This loser worked over 40 years and is now retired. If you don't like the fact that I smoke weed, deal with it.

Those like you cannot ever say anything positive. If fact, your kind would rather lie that tell the truth it seems. First I was told how I would be paying more for auto insurance. In fact, I will be paying about 30% less. I was told the property taxes will be high. In fact they are about 50% lower than where I live now.

It is ironic that you conservatives holler about personal freedom and all, yet cannot stand it that some of us are using this personal freedom to do something you don't like. Well, my suggestion is to stay out of Colorado.

Well, my suggestion is to stay out of Colorado.

Or at least the liberal counties. My general impression is that most of the state geogrpahy wise has not become a pot paradise.

That aside, I think Texas should give people arrested twice for possession of marijuana the following in lieu of jail:

-bus passes to Colorado
- four months rent in an apartment
- Monthly allotment of weed for four months

My bet is that many wont want to come back, and this will result in an over all net productivity gain for my state.

I agree. A visitor to Denver will barely notice any pot smoking or selling. The city operates pretty much as normal, except for the increased tax revenue.

Having not been arrested I don't qualify, but four months of weed allotment would be nice. :2wave:

My bet is that many wont want to come back, and this will result in an over all net productivity gain for my state.

Don't bet on it.

In my case, my leaving Texas will result in a loss for the state. I will no longer spend all of what I earn here, and I will also still receive a little money from Texas every month.

You smoke weed ??

Shock ~!!!!

Not really.....God's speed to Colorado. Your arrival will no doubt coincide with cumulative lowering of the State IQ.

And Conservatives believe in the rule of law by the way. Maybe you wouldn't be so loyal to a corrupt ideology if you truly understood what Conservatives believed in .

And " rights " ??

I should have just as much right to not raise my family in a society inundated with dumbass stoner losers that you have to run off and pickle your brain.

Perhaps, but I know my leaving Texas will lower theirs.

I understand what conservatives believe; I read your postings. What you believe is like a **** pie. You claim it taste good, but I know what **** smells like. I'm not buying it!

As I have the right to live in a society not inundated with dumbass conservatives. That's why we have state's rights. You stay in a state that doesn't allow marijuana and I will move to one that does.

Perhaps, but I know my leaving Texas will lower theirs.

You should be heading West then, to California ! They are in desperate need of a IQ injection.

You might want to start saying " nope to the rope " first. It's called " dope " for a reason.

No you do not.

Here's a suggestion. Try to not read my post HIGH ON ILLEGAL DRUGS !

:2wave: Like I said earlier, God's speed ! We're so much better off when people like YOU leave. There are homeless pot head losers arriving by the bus load in Colorado. I'm sure you'll fit right in.

You'll have to talk to your family when it comes to bus rides and losers. I will not be arriving by bus and I am not homeless. I will move into a home I purchase and enjoy thinking about you working while I'm relaxing. Don't worry, if I notice any of your children wondering around the bus stop, I'll take pity and smoke a joint with them. :lamo

Breaking into your shed is not threatening your life, or putting your life in danger.

You'd be reasonably tried for some level of homicide or manslaughter.

Your lawn mower isn't worth killing somebody over.

What if this is your lawn mower?;)

Ooooo I am so impressed with your faux-macho, big talk, lethal decisiveness.../QUOTE]

Don't worry. People like this are all talk. I wouldn't be surprised that if Vic ever had to actually face this type of situation he would wet his panties.

Is there a source on this? I am in Colorado right now. Far from a hell hole. Beautiful state and one of the healthiest. I haven't heard that that homeless rates are jumping up either. Marijuana legalization is not hurting anything here.
