Charged with what the driver was charged with, I would venture to say he was on the clock.

If he was dispatched, he should have told the dispatcher he needed rest or sleep. two wrongs don't make a right, besides, most GOOD dispatchers will ask drivers if they are ready to run.

The drivers are supposed to log all their hours of course.

It's harder to avoid it these days but not impossible.

I worked on a project for some of the commercial truck tracking diagnostic software...those guys have EVERYTHING tracked these days. Plus the diagnostics are hooked directly into the truck engine and other systems....they know exactly when and where and how long a truck is just idling. They can track every pee break. It was pretty cool.

But so much for the 'freedom of the road.'

I don't know Lursa, where did this information come from that he'd been awake for 24? Did the driver make a mistake and tell a trooper that? or did media distort the truth? His attorney said recently on twitter that what the media posted was a lie, who to believe?

No idea. It's what I heard in the media as well.

This is inexplicable, how can this happen? Aren't those Walmart drivers tracked per DOT regulations? If they are, why didn't his dispatcher tell him he needed time off?

This accident should never have happened IMO.
They are humans and humans make mistakes. That said, I always tell the wife to stay as far away from commercial trucks as possible.
And I am in the industry.

The trucks are safe.
 
Disagree unless you can prove someone higher up ordered the driver to break DOT rules. If supervisors told drivers to fudge the rules. Then yes, the driver and the supervisor needs to be held accountable.

People need to take responsibility for their actions. Start with the driver. Even if a supervisor stated to the driver your on for 24+, the driver should have said, no way.

CDL drivers are considered trained professionals and under the law, are responsible for ensuring that they drive safely which includes adequate sleep.

No the accident should not have happened. I do not know the drivers experience but i do know this HE KNEW BETTER it is taught to get plenty of rest in this industry. Well he was african american and as we are starting to see they think they are above the laws of this country now.

Yup trucking is a tough job. hardest part is all the morons in four wheelers that have no clue how to drive! Texting and driving at over 70 is rampant the most dangerous things on the roads are four wheelers that think they can drive.

You sir are correct, we are not considered professionals we are professionals. This Guy WILL go to prison and he deserves it he knew better I assure you.

As for me I do think that most four wheelers need to have a more intensive driver training as truckers do. Accidents would be cut in halve in this country.
