One Percenter Convicted Of Raping Infant Child Dodges Jail Because He 'Will Not Fare Well'
A Delaware man convicted of raping his three-year-old daughter only faced probation after a state Superior Court judge ruled he "will not fare well" in prison.

In her decision, Judge Jan Jurden suggested Robert H. Richards IV would benefit more from treatment. Richards, who was charged with fourth-degree rape in 2009, is an unemployed heir living off his trust fund.
A more appropriate sentence would be a 45 caliber slug. And the judge needs a smack upside the head.

Avoiding jail because jail would be unpleasant???

What kind of F'd up article is this from Huffcrap?

As best as I can tell, this creep has been labeled a "1 Percenter" because of his name alone. Nowhere does it mention how wealthy he is, other than he is a great grandson of a DuPont, and he's got a trust.

How about just reporting that this scumbag is getting probation, rather than the pathetic reference to wealth, which may or may not be true?

Interestingly...the state attorney general that presided over this case has a rather well known father...

Affluenza.

I don't care about the guys background or circumstances, he admitted to molesting a child.

The fact he was able to play the justice system is simply unfortunate, he should have gone into prison and if that resulted in his death well then he shouldn't have molested a child

Oh please, if this guy were some minimum wage Joe with a public defender, he'd be locked up with bubba 30 years.

It's not just the Judge, it's also (and mostly) the DA who downgraded the charges. The original charges would have gotten him a mandatory minimum of 10 years.

The inane "One Percenter" mention in the report just tells us how stupid the reporter is.

One percenter?

Would it be okay if he made his living pumping septic tanks?

There are a lot of morons who let off the kiddie rapists. How about MN district court judge who just granted nothing but probation to Gary Hegna even though he repeatedly raped a 7 year old girl? He's no one percenter.

That guy should be in prison too

This must be a joke:

Superior Court of Delaware Official Web Site
Judge Jurden was the 2011 recipient of the Outstanding Service to the Courts and Bar Award, presented by the Delaware State Bar Association to a judge or lawyer who “by exemplary service to the Delaware Courts and the Delaware Bar has substantially assisted the Courts and the Bar and strengthened the public trust and confidence in the State’s court system and the administration of justice.”

It's fairly obvious there's a two tier justice system, one for the wealthy and another for the poor. It's not a perfectly two tier system, but close enough to make generalizations, and this example proves the general rule.

Robert H. Richards IV, 47, who is supported by a trust fund and who paid $1.8 million for his 5,800-square-foot mansion near Winterthur Museum...
...
Currently unemployed, Richards IV also lists a home in the exclusive North Shores neighborhood near Rehoboth Beach as a residence,

Can't trust a liberal judge can ya?

I've become familiar with the story. The guy is a scumbag. The two tier system you're referring to is such a tiny sliver of what happens in the justice system that it hardly can be measured. It's the hope of people behind Huff's story that the number is significant.

However, I think the headline proves Huff is worthless. Why the reference to "One Percenter". It's bull.

Do they run stories about people on welfare who have done similar things getting probation? Do they run articles about illegal aliens being released, only to go out and kill?

It's obvious what the big picture the reference is designed to convey, and I stand by my statement, which is based in the spirit of Huffcraps headline.

It's clear by the guys actions he is a 99 Percenter who got lucky at birth.

There wasn't enough evidence to convict him and he took a plea bargain. He might have been guilty, might of been innocent. It wouldn't be the first time a child was coached to say things to cause such an indictment.

Who is the other rich person who raped his daughter and got away without jail time?

If you disagree with the broader point, that's fine.

But let's put it this way. This guy, from a famous legal family and famous industrial family with connections all across the elite levels of that area, could write a check for what was surely a mid-six figure defense after it was all over, at least. Assume a rural white guy working minimum wage with the same charges, represented by a public defender or some guy 2 years out of law school. If you're betting which one would get the lighter sentence, are you contending the odds are anywhere close to 50-50? That a bookie would give even odds on that bet? I'm thinking I'd need a 10-1 payoff at LEAST to take the Walmart worker.... 50 or 100-1 is probably closer to the real odds.

Is everything in the world just black and white to those who lean right? It sure seems that way.

The same question for those of your bent. After all, it was YOU who posted about the "one percenter". To me he just looks like a child rapist. Some of that sort have money, some don't.

So you agree you can't generalize?

This guy was let out because the judge, prosecutor and DE attorney general failed. It's happening all over the country.

He's a child rapist who's well off financially and more than likely has some political connections. Maybe that old family money is helping that judge advance her career?
