President Barack Obama's administration appealed a federal court order Wednesday ordering the Pentagon to stop having guards search the genitals of Guantánamo Bay detainees before and after they meet with their attorneys.According to the appeal, which was first obtained by the the Miami Herald, the searches were warranted because the guards were finding “dangerous materials and other contraband” in prison cells, though none of the items were used in attacks against guards, nor is there evidence that the attorneys provided the detainees with the contraband.
The appeal did state, however, that "prison officials are entitled to take preemptive measures to ensure the security of their facilities.”
The Obama administration also filed an emergency administrative stay, asking a judge of the U.S. Court of Appeals for the D.C. Circuit to delay the federal court's order pending the appeal.
