ACLU Suing Obama Administration Over Phone Records Gathering

The American Civil Liberties Union and the New York Civil Liberties Union filed a lawsuit Tuesday against the Obama administration, challenging the constitutionality of the phone surveillance program revealed by The Guardian.The suit alleges that the program violates the First and Fourth amendments.
The suit takes issue with the so-called metadata that a Foreign Intelligence Surveillance Court compelled Verizon Wireless to hand over to the National Security Agency under Section 215 of the Patriot Act.
"The practice is akin to snatching every American’s address book—with annotations detailing whom we spoke to, when we talked, for how long, and from where," said the ACLU in the complaint. "It gives the government a comprehensive record of our associations and public movements, revealing a wealth of detail about our familial, political, professional, religious, and intimate associations."

Apparently they're also not afraid to lose. Its been tried and this raises all sorts of questions regarding the Supreme Court's jurisdiction to even hear such a case (Yes, for those of you who don't know, even the Supreme Court has limited jurisdiction). The conservative majority on the Court has already taken the position that its interference may constitute a violation of the separation of powers. The only party in all of this which has a chance of stopping this program is Verizon. It is the only party with the legal standing to challenge the FISC order itself.

Verizon has no problem with turning over its customers' data. Neither does AT&Treason. They were all granted immunity for the dirty work they did for Bush & Co.
 
Good for them. I used to merely say that Obama is the great disappoint of my life. Now it's more like he's descended into cartoonish supervillain status. He is little better than W ever was.
 
If you're giving this information freely to your cell carrier as part of the service you receive from them, I find it hard to feel like I'm being spied on or that my constitutional rights are being trod upon. It would seem as if though Verizon et al should warn users that such information is being freely given to them, and give them an option to prevent Verizon from seeing it. Once you've voluntarily given such info to a third party, it's tough to argue that its really private anymore, imo.
 
Why do you say that?

Either Libbo operatives will pressure the ACLU into dropping the case, or Obama will throw them a bone. This won't go very far.
