    There is something not right with this story as presented. Police approached him for roughhousing in the surf--he slammed somebody to the ground--he was just walking with a puppy to show them his mom--and the mom just happened to be there with a camera recording his arrest.

    If this happened between 2 civilians, isn't the red line when somebody puts their hands on somebody else?

    Who would get charged with assault if one was using words and the other used his fists?

    There are better ways to handle the situation. Cops get lip all the time but the smart ones use their heads to deescalate the situation (especially when we're talking about a simple civil violation). Unfortunately it seems that this day in age the cops more often react to situations instead of respond to them which turns little stuff into big stuff.

    Absolutely ridiculous if this is the full story on what happened. The police stated that the 'clenched fist' is considered an 'immediate threat.'

    I swear, some of these stories I hear coming from Florida are so ludicrous they could be written by The Onion. Maybe its all that sun?


    I'm looking into this one.

    Here are my immediate thoughts:


    The stories of the police and the boy and family differ considerably. The boy is saying he was taking the cops to his mom as requested, and reacted to being grabbed. The cops are saying his body language and behavior was indicative of threat, and they took him down because they believed he was about to be violent. They're claiming he was resisting arrest when he jerked his arm away from a grab.

    It's hard to say exactly what REALLY happened here, but given that we're talking about a 14yo boy, my immediate reaction is that this was a bit over the top.

    There's also this:

    McMillian was charged with a felony count of resisting arrest with violence and disorderly conduct, according to Miami New Times. His case is reportedly scheduled for trial in July.

    That is nuts. Jerking away isn't felony resisting, nor is posturing or fist-clenching in and of itself, violence. Pretty sure this charge will not stand as is. Damn, if I'd charged everyone who tried to jerk away from me with felony resisting when I was in LE, that would have been a long long line...

    Does the kid have an attitude problem? After watching the video I'm pretty sure he does, yeah.... but I'm thinking the cops that took him down probably do too.

    yeah, something does not gee-haw here.... but I'm figuring both sides are exaggerating at a minimum.

    The video doesn't show the cause, only the effect. My head tells me that yeah, the officers overreacted and escalated a situation that could have been solved quietly and peaceably if, like on COPS, there was a video team following them around. But without seeing the entire incident on film, it's he-said, he-said.

    I just find it difficult to believe that a kid feeding a tiny puppy appeared menacing enough for the police to even approach.

    .... If a cop is wrong ill mouth up to him. His badge means nothing to me. He doesnt protect me. He shows up after all the crap goes down to write a ticket and be an asshole. Except for the small minority of cops ive met who do it simply to help others instead of seeking a position in society with power over others. Just speaking from personal experience here.

    If I see a cop beating a helpless person on the ground you better believe ill assault that cop until he stops. Probably even take his weapons away and throw it in a bush because he obviously shouldnt have them. Just because he has a badge doesnt mean he can punk people. Of course I would probably end up in prison but id be willing to make that sacrifice to help someone beating unjustly beaten. (not saying that beating people should ever be justice...)

    They prolly trumped it up because they knew they couldnt win and wanted the trump up to be an obvious reason for dismissal.
