    WaPo: White House senior aides knew details of IRS probe but didn’t tell Obama, spokesman says

    Senior White House officials, including Chief of Staff Denis McDonough, learned last month about a review by the Treasury Department’s inspector general into whether the Internal Revenue Service targeted conservative groups seeking tax-exempt status, but they did not inform President Obama, the White House said Monday.

    The acknowledgement is the White House’s latest disclosure in a piecemeal, sometimes confusing release of details concerning the extent to which White House officials knew of the IG’s findings that IRS officials engaged in the “inappropriate” targeting of conservative non-profits for heightened scrutiny. Previously, the White House said counsel Kathryn Ruemmler did not learn about the final results of the investigation until the week of April 22nd, and had not disclosed that McDonough and other aides had also been told about the investigation. On Monday, White House Spokesman Jay Carney said a member of Ruemmler’s staff learned of the probe the week of April 16; Ruemmler learned of the investigation on April 24th; and after that point she informed the chief of staff and other aides about the probe’s findings.

    The White House has said President Obama did not learn of the IRS’s actions until he saw news reports on the matter earlier this month.

    In a series of TV appearances on Sunday, White House senior adviser Dan Pfeiffer said the White House did not know the details of the investigation or its conclusion until it was released publicly last week, he said.

    On Monday, Sens. Max Baucus (D-Mont.) and Orrin G. Hatch (R-Utah), who lead the Finance Committee, wrote to Steven T. Miller specifically requesting “documents relating to communications between any and all IRS employees and any and all White House employees, including but not limited to, the President, regarding the targeting of organizations” seeking tax exempt status. The senators also want to see “any written communication, memos, policy drafts, or other documents” related to the IRS’s consideration of tax-exempt status since 2009.

    Miller is set to testify Tuesday before the Senate Judiciary Committee alongside his predecessor, former IRS Comnmissioner Daniel Shulman, and J. Russell George, the Treasury inspector general for tax administration who wrote the audit report detailing how IRS employees improperly targeted certain groups.

    On Wednesday, Shulman and George are set to testify before the House Oversight and Government Reform Committee, alongside Treasury Deputy Secretary Neal Wolin. George told the Ways and Means Committee last Friday that he first informed Wolin about his audit during a meeting last summer.

    The White House on Monday once again added to the list of people who knew about the IRS investigation into its targeting of conservative groups — saying White House chief of staff Denis McDonough had been informed about a month ago.

    Press secretary Jay Carney said again that no one had told President Barack Obama ahead of the first news reports: not his top aide McDonough, nor his chief counsel Kathy Ruemmler, nor anyone from the Treasury Department.

    Monday’s revelation amounts to the fifth iteration of the Obama administration’s account of events, after initially saying that the White House had first learned of the controversy from the press.

    Republicans are training their attacks on acting IRS Commissioner Steve Miller amid new revelations that he and the agencyís former top official knew employees were targeting conservative groups but failed to notify Congress despite repeated requests.

    Utah Sen. Orrin Hatch, the top Republican on the Finance Committee, and 10 other GOP lawmakers wrote to then-IRS Commissioner Doug Shulman on June 18, 2012, demanding answers on why the agency requested donor information from groups seeking nonprofit status.

    By the time this letter was sent, Shulman and Miller, who was the deputy IRS commissioner at the time, had been aware of the extent of the targeting program for about a month.

    Still, in a Sept. 11, 2012, response to the letter, Miller offered a broad interpretation of the law allowing the request for donor information and said nothing about the targeting practice.

    The letters between Hatch and Miller are written in dry tax-speak but are shaping up as central to GOP claims that Miller hid what he knew about the targeting, even as Hatch and others asked the IRS directly ó and pointedly ó about whether it was going on.

    But Millerís reply gave no hint that he did, in fact, have knowledge about what Hatch was seeking.

    While this was happening, several committees in Congress were writing numerous letters to IRS Commissioner Douglas Shulman to express concern because tea party groups were complaining of IRS harassment.

    In Shulman's responses, he did not acknowledge targeting of tea party groups. At a congressional hearing March 22, 2012, Shulman was adamant in his denials. "There's absolutely no targeting. This is the kind of back and forth that happens to people" who apply for tax-exempt status, Shulman said at the House Ways and Means subcommittee hearing.

    IRS headquarters in Washington denied that a no-talk rule was official policy because, after all, agency staffers still have a constitutional right to talk to whomever they want. "Our policy is that press inbounds (queries) are referred to the press office," a spokesman said. "But people have First Amendment rights, they are entitled to speak."

    Asked whether employees were reminded of the official media policy this week, the spokesman said "no."

    Not so, said IRS folks in Cincinnati. One of them, who asked not be named, told ABC News that security guards did remind employees of the official policy not to talk with the press – a warning cemented by the punch line "or risk losing our jobs."

    Even leaders of the local union that represents the IRS workers under fire took the admonition to heart, hanging up on reporters who wanted to ask questions about the scandal. One longtime IRS worker and union member called the response by the National Treasury Employees Union "dazzling."

    On Thursday morning, after news that Miller was sacked, two ABC News journalists walked into the Peck Federal Building in Cincinnati looking for answers. The newsmen were screened at the door by security. They emptied their pockets as instructed, removed their belts, then went through the metal detectors.

    We wanted to ask who about made the decisions in the unit and when the profiling started. And whether those decision makers been identified yet.

    But the answers – like the people involved – remained elusive.

    As we traveled the public hallways of the building – watched over by security cameras – an armed uniformed police officer with the Federal Protective Service followed us. We were looking for a particular office—of someone who would not want to be seen talking to reporters--but chose to bypass it because of our official babysitter.

    Asked why we were being escorted in a public building, the officer identified himself as Insp. Mike Finkelstein and said he was only trying to make sure that the newsmen were not a "nuisance." He brushed aside further questions. The cop said a supervisor would call to explain.

    One of the reporters wanted to know if the act of following the journalists was an effort intended to scare off any federal employee who might have considered speaking to the press. That's sure what it looked like; and, even if that wasn't the goal, it was the effect.

    As of Friday night, no supervisor had called back.

    After ABC News phoned and e-mailed the spokespeople in Washington repeatedly for more than 24 hours, a low-level staffer with Homeland Security finally responded. "After review by a supervisor, it was determined that the inspector acted according to proper security procedures and that no improper conduct occurred," the spokesman said.

    Whether improper conduct occurred at the IRS—and who was responsible for targeting the president's enemies, as some members of Congress have argued – will be subject to much more review.

Hatch of Utah, the ranking Republican, forwarded a six-page letter to Steven Miller, the acting I.R.S. commissioner, who announced his resignation last week. It contained 41 pointed questions about the I.R.S.’s efforts to single out for special scrutiny conservative groups applying for tax-exempt status. Those questions, which are to be answered by May 31, go well beyond the agency’s actions and address the questions Republicans have been asking for a week: Who in the Obama administration knew what? And when did they know it?

    Provide copies of all documents between I.R.S. employee(s) and anyone else regarding the targeting of applications based on the existence of certain phrases and/or subjecting those targeted applications to full development and heightened scrutiny,” the letter read.

    Was the decision to target any tax-exempt applications for review and subject them to full development or heightened scrutiny influenced or prompted in any way by political pressure directed at the I.R.S. from any members of the Congress or other elected officials?” it asked.

    Provide documents relating to communications between any and all I.R.S. employees and any and all White House employees, including, but not limited to, the president, regarding the targeting,” the letter said.

    The document also demanded the identity “by name, grade and position title” of “every I.R.S. supervisor, I.R.S. manager or other I.R.S. employee who became aware that any individual in the White House or Treasury Department became aware of any improper targeting.”

    The Finance Committee will convene a hearing on the issue on Tuesday featuring Douglas Shulman, a Bush administration appointee who led the I.R.S. while much of the targeting was taking place and who has not yet been questioned.

    “I have a hunch that a lot more is going to come out, frankly. It’s broader than the current focus,” Mr. Baucus said on Bloomberg Government’s “Capitol Gains” television program. “And I think it’s important that we have the hearings, and I think that will encourage other information to come out that has not yet come out. I suspect that we will learn more in the next several days, maybe the next couple, three weeks, which adds more context to all of this.”

    So they knew about the investigation, so what? They didn't know the results until recently. How is this damning of the Republicans? This doesn't exonerate the WH or Treasury for what they did, target rightwing groups so they were less effective during the Presidential campaign. So this apology from the IRS was an attemtp to get ahead of the **** hitting the fan, and wasn't even sincere. Seems more damning of the Administration than ever.
