    Fight to patent human genes goes to Supreme Court

    On Monday, the Supreme Court heard Myriad Genetics plead their case on why they want to patent human genes. According to the biotech company, it discovered the gene linked to higher risks in breast and ovarian cancer and plans to further its research. RT's Liz Wahl has more from the Supreme Court.

    The issues are a little more complex than that. Basically, companies spend millions of dollars tracking down gene sets that elevate risks to certain medical conditions. Without a patent they could stand to not profit from that money spent, making them unlikely to continue such research. However, it is still patenting something they found, not something they made. There is a possible compromise solution that neither side of the argument is happy about. From what little I have read, it strikes me as one of those things with no real good solution.

    The argument against the company though with the patent is that they didn't really make anything new. They just removed something from the body. Much like you can't patent a kidney just because you removed it nor can you patent the body just because it no longer has the kidney.

    Yes, I understand that and stated it. The problem is that without a patent, there is little financial reward for companies doing this research. It isn't a simple, clearcut issue.

    Well, it kinda is clear cut when you take a look at what a patent is and what it is for. I understand there will be ramifications if they rule it doesn't fall under patent protection, but the simple fact is that nothing new was made, only removed and that shouldn't fall under patent protection.

    They should be able to patent the PROCESS for whatever they be doing. But the actual genome if it comes from a live human being, is owned be said human being. I think the patent process and law needs to be revised though.
