CHICAGO (AP) — A federal court ruling tossing out Illinois' ban on concealed weapons might end the last such gun prohibition in the country, but not without an expected fight.

The question is whether the battle will be an appeal to the U.S. Supreme Court, which has been silent on the issue of concealed weapons, or a legislative confrontation over the court's order that Illinois adopt a law allowing concealed carry with "reasonable limitations" like other states have.

Illinois Attorney General Lisa Madigan's office said she is studying the issue, while gun control advocates quickly urged her to appeal Tuesday's ruling by the 7th U.S. Circuit Court of Appeals that Illinois' ban is unconstitutional. But the ban's defenders said they were more certain of fireworks over a second part of the ruling — an order for the Illinois Legislature to come up with a law legalizing the concealed carry of weapons within 180 days.

In the appellate ruling, Judge Richard Posner, author of the majority opinion, suggested that there was no excuse for the state not to join the rest of the nation when it comes to concealed weapons. He wrote, "There is no suggestion that some unique characteristic of criminal activity in Illinois justifies the state's taking a different approach than the other 49 states."

But the majority included the 180-day stay of its ruling to "allow the Illinois legislature to craft a new gun law that will impose reasonable limitations, consistent with the public safety and the Second Amendment as interpreted in this opinion, on the carrying of guns in public," Posner wrote. The fight in the Legislature would be over what constitutes "reasonable limitations."

At the same time, Flynn Currie, the House Majority Leader, said she is encouraged by the court's silence on the right to carry concealed weapons, and wants Madigan to appeal the ruling.

The Supreme Court's rulings on the Second Amendment were "very limited, saying the home is your castle, and it didn't apply to other places," she said. "For that reason, it's worth checking on that question."

Plus they wont be able to restrict around schools, or anywhere else. As that would be a ban. Note what the Demo Politician says is the reason to take this to the Supreme Court. See the games the Democrat politicians play. Does anyone think her EXCUSE should be the reason to take this issue to the Supreme Court? Chicago and Illinois is not Special. What don't Illinois Politicians Understand about their own Mantra of Whats Fair for Everybody.

Just what is up with the Progressives and that mantra. Fairness for all. Equaling the Playing field so to speak. Shouldn't any arguments brought up by the left be smacked Right back down on them with their own words?

I will withhold that judgement until we see what "reasonable restrictions" that this court allows. If these same "reasonable restrictions" are allowed to be placed on the right to vote, then I am fine with the decision. In most cases the same "reasonable restrictions" should be applied to the right to vote, i.e. denied to those that are convicted felons, legally insane or not legal US residents/citizens. It is amazing that nearly universal agreement exists that guns/ammo should not be sold without presenting a valid, state issued, photo ID and that convicted criminals and the insane may (must?) be denied this "right", yet the same "reasonable restrictions" constitute a "discriminatory burden" when applied to voting.

The gun rights backers interpreted the 2-1 appellate court ruling as a mandate instructing lawmakers to pass a bill allowing citizens to carry concealed weapons in public with few if any restrictions. Todd Vandermyde, a National Rifle Association lobbyist, said gun control advocates could forget any limits such as partial bans near places such as day care centers and schools.

"It's over for them. They have no stroke in this game, they have no negotiating power," Vandermyde said. "When you start drawing circles around all those places — day care centers, schools and parks — that's a ban and they don't get a ban. They lost.....snip~


That's what the NRA is saying though and that they will push for the Statewide in 2013. But I agree with you concerning people being around Schools or day care centers with them guns.

.....did ya hear them talking about this? Already the Demos are trying to say it will put more guns out into the public. Causing more shootings and injuries as well as deaths. Yet while he was saying this.....it must have been a Taboo for the Reporters to not bring up the issue of Chicago and all the violence and shootings taking place this year. Or how since Chicago or Illinois already had the Conceal Carry in place and how was that working out with the more guns out on the street.

Mainly hitting the Democrats with.....hows that working out now Since your City is leading the Nation in Shootings and Murders. Just how is your Absurd argument stopping or decreasing any gun violence whatsoever! What happened? Where are your made up numbers now?

These reporters cannot be scared to ask the Right Questions and not damn useless questions about Obama and the Fiscal Cliff when they are talking about this damn issue. But this is what they do. Never putting the Politicians on the Spot. I would like to see it done to both Sides. But obvious more focus has to be on Progressives and Liberals so that they are not allowed to go off on tangents and talk about other things which don't apply to the Subject at hand.

For 20-30 yrs the Clintons have pushed that gotcha moment with the Media. 30 years later now all the Demos use that line. They wont play the gotcha moment.

I am going have to agree with you on this part.I see the anti-2nd amendment loons in Illinois imposing all sorts of infringements like an expensive fee,finger print submission, and all sorts of other infringements to make it nearly impossible for an average citizen to be able to carry a concealed weapon.
 
It is baffling to me how so much of America at a local level is so conservative but somehow obama got reelected.

You should probably wait to see what those judges consider reasonable limitations.
 
We've read Chicago news stories about huge groups of (insert appropriate word here) attacking a single jogger, flash mobs that steal and beat others. Yet the shrieking loons absolutely do not want victims to be able to defend themselves. The loons stand with the attackers and disarm the victims. In places like Chicago, in situations like the unreported extensive looting after Hurricane Sandy, law abiding citizens must be able to fight back or they will die. That is the planned future of liberal America. The more agitation, chaos and disorder, the more government is required.

DO NOT let the liberals turn you into a beaten, cowering victim, terrified to leave your house because the liberals have enthusiastically turned your once beautiful country into a 3rd world jungle where you, your family and your children are the prey of designated favorites that the liberals refuse to prosecute. The media won't even report that someone in your family has been raped or killed because the media wants to protect the perpetrators, the suffering of your family means nothing.

If no one speaks for you, your gun will. Your gun is your best friend and you can bet that voice will be heard. Understand this: The police are not coming to help you. Being a beaten, raped or worse victim will devastate you emotionally for the rest of your life. Don't allow anyone to take your honor and dignity away from you.

Many loons are actually so naive as to believe that immediate surrender and submission guarantees safety and good treatment. The opposite is true, surrender guarantees pain and death. Those who would harm you like that, they enjoy it. They enjoy your suffering and they will deliberately hurt you so they can laugh at you.

Yup! Take a good hard look at the process in Massachusetts. I'd bet that Illinois uses it as a road map.

Anti-2nd amendment loons do not give up so easily. He will do everything he can to make it costly and a pain in the ass for someone to exercise their 2nd amendment rights.

...and like restraining orders, many of us walk right through those restrictions and do it anyway. Where I used to live, I would have had to drive well out of my way to get home to avoid the school zones when I was carrying. Nope. Drove right through them. Walked right into the Massachusetts State House carrying about 12 or 13 years ago (before they installed the metal detectors). Walk right into city hall and the police station armed on a fairly regular basis.

I would contend that no-gun zones around schools have led to earlier reporting of visible carry on or near the sites. It won't stop somebody dead set on causing problems, but it WILL make them stand out and may result in more lives saved by quick action than would otherwise occur.

"visible carry"? I am not and never have been a proponent of open carry. The states I travel to have Concealed Carry only. That means if you can see I'm carrying a gun, I've committed a felony called "Criminal Menacing". Very few of these school shootings are impacted in any positive way by these school gun bans. About the only thing they do is ensure the staff and administrators can't have a firearm in their car to potentially stop the nutjob with.

"I wonder if people realize this means we'll have people walking around with loaded and concealed handguns????" :rofl Maggie says, "What do you think is happening NOW????" What a joke. 49 states have concealed carry laws. We are not re-inventing the wheel. He talked about the mentally ill having guns saying that, nationwide, "500 homicides were committed by people with concealed carry permits!!" "In what length of time, Senator?" the DJ asked. "Since 2005." Give me a freakin' break!!!!! We have that many homicides in the city of Chicago every YEAR -- by people who have no right to carry a gun -- who don't even have permits. Such a loaded argument. Made me sick.

We had concealed carry on my University and there was never a problem. In high school kids were allowed guns on campus (not in the school proper, but they could be in their cars), no incident.

Yeah, and Emanuel came out yesterday Criticizing the Judges who Ruled on this. Also Immediately Quinn said they will still have to have limitations for the mentally Handicapped, Criminals, and those caught up in Domestic violence Cases. Also he said he now will push his Assault Weapons Bans.

if one is still in HS at the age where a CCW permit is authorized, (21) that person is probably too stupid to carry a weapon
