    It has already been established that the neighbor lied to the police about hitting the child and the mother was not doing anything wrong. "The unsubstantiated felony charges against her were dismissed" and "Child Protective Services found no cause for concern regarding the well being of Cooper’s children and dropped the investigation."

    I thought it was about her leaving the children unattended. I guess I skimmed over too fast, because I missed the part about abuse. I wonder why the police would arrest someone with nothing but the word of a neighbor? The whole thing sounds pretty ridiculous to me.

    Making a false police report, harrassment, slander, invasion of privacy, etc. are all intentional torts, and most of the time the homeowner's insurance policy will not cover them. It would be contrary to public policy if they did.

    Don't you find it odd that the neighbor could report (falsely or not) that she had struck a 6 or 9 year old with her car and yet wasn't arrested for leaving the scene, hit and run, etc.?

    2. Calling someone's kids 'trash' is a good way to get ones' face smashed. certainly it is not obedience to the social laws that you claim to be a proponent of.

    The duty to defend is greater than the duty to indemnify. As I stated they will seek to recoup on defense costs should she have purchased this type of coverage in her homeowners policy. People generally do it is inexpensive and the coverage is adequate for these types of activities.

    I find the whole thing strange; procedurally, it was poor police work: an accident and no medical personnel were in attendance, the neighbor was not confronted about her story the police only went to the mother and arrested her.

    Exactly. Most neighborhoods are completely acceptable for kids of that age to play in without being literally within sight at all moments.
