This is just a small victory. Maybe the NYPD were just out to knock those "Un-American hippie heads"? Who knows. But just a small victory.

Not the skullduggery you want to make it out to be. It appears to be simple failure to warn due to poor police procedure. The people involved in OWS have rights and those rights are being protected.

What you have failed to mention is that the judge did not find a "pattern of misconduct" for which Bloomberg, Kelly and the City did nothing, therefore, "the ruling dismissed the mayor, the police commissioner and the City of New York as defendants in the suit, saying that there was insufficient evidence that those parties were responsible for any misconduct by the police."

Walking in the streets on a peaceful march is still peaceful.

I'm no fan of OWS, but they have a right to protest. If the assembly is peaceable, there's no grounds for intervention by law enforcement. If they were entrapped, which is the ruling, then I think the reparations to those wrongfully arrested should come from the pockets of the officers involved.

Since when do police need to warn someone before arresting them? Do they need to send it in writing, in triplicate, too?

as long as you are not striking others, you are being peaceful. Non-violent protest and passive resistence includes blocking traffic with your passive body.

Just because some form of protest is "non violent" does not mean it is legal.

They must allow people to disperse before making arrests. They usually give 3 or 4 disperse announcement before making a arrest at protests.

indeed, they should have warned the people on the bridge that if they did not walk back towards Manhattan they would get arrested.

however, if the NYPD told the folks before they went onto the bridge that if they walked on the bridge they will get arrested, that's another story.

however, walking on the car lanes of the Brooklyn Bridge without a protest permit, is pretty much asking to be arrested. Being arrested is part of the whole strategy of non-violent resistance and peaceful protest, so fighting it in court is kinda...well...lame.

Never heard that before, but it makes sense.
