Arizona bill could criminalize Internet trolling

I don't see how, as written, that bill will pass Constitutional muster, specifically the 1st Amendment, since it is not illegal to "annoy or offend" anyone in person, nor should it be. And I'm pretty sure the first time this is challenged (if it even makes it into law), it will get struck down.

Arizona House Bill 2549 has already passed both of the state's legislative bodies and is currently sitting on the desk of Governor Jan Brewer. While there's a lot in there that doesn't concern trolling, here's the line that has people worried:

It is unlawful for any person, with intent to terrify, intimidate, threaten, harass, annoy or offend, to use ANY ELECTRONIC OR DIGITAL DEVICE and use any obscene, lewd or profane language or suggest any lewd or lascivious act, or threaten to inflict physical harm to the person or property of any person.

It is the right of american to offend, specifically by using obscene, lewd or profane language. We aren't Canada.

However one has to consider hamsters in regard to android as cyborg hamsters are very cool. Imagine how fast an Android hamster could run in their exercise wheel for example.

intimidate? (There goes the 'look up my nose' tactic, damn)
threaten? (There goes the 'you're all doomed' tactic, damn)
harass? (There goes the repetition tactic, damn)
annoy? (My favorite, damn)
offend? ('both parties are the same', damn)

I knew I made a good decision to stop voting. It seems to not matter who you vote for, you end up with the worse aspects of both party's.

The people who wrote, sponsered, and voted "yes" for this bill should all be voted out of office next election cycle.

It seems Arizona has become the right wing whacko counter to Hippy California. Many laws of late are head shakers. For all big brother is despised in some regards, it is embraced swiftly on others.

I wish that were true. A lot of jobs would be lost if our government acted on its original intention.

not a chance this survives a legal challenge.

Re: Trolling Could Get You 25 Years in Jail in Arizona

Great....another thing to throw us in jail over. And we wonder why we have the highest incarceration rate. Jesus tap dancing Christ people, the answer to everything isn't "more jail time! more government! more monitoring!".

I had a response written that supported this legislation because it would make intimidation and threats on Facebook actionable much more easily. Then I read the legislation:

"It is unlawful for any person, with intent to terrify, intimidate, threaten, harass, annoy or offend, to use a ANY ELECTRONIC OR DIGITAL DEVICE and use any obscene, lewd or profane language or suggest any lewd or lascivious act, or threaten to inflict physical harm to the person or property of any person."

Annoy or offend?

I'm going to jail.

Yeah man, wtf. And could you get rid of your damn signature under every post? It's annoying you butthole!

I'm going to jail.

So, that's why I got a pm from Dianna for bail money.

I'm going to jail.

How many of us wouldn't be in jail?

I guess my question is this stuff the internet bill trying to cover criminal now? I mean if I call someone on the telephone or talk to them in person and threaten them with bodily harm is that illegal? If I say something lewd or obscene to someone by any means is that legal under today's law? I see no reason to make it illegal just because it is done over the internet nor do I think we need some special law for something that is already illegal. Annoying and offending is a constitutional right.
