She makes a very valid point that the world is different than it was in the 1700's, and a lot of knowledge and experience can be obtained by looking at how the world has developed.

The US constitution was not created perfect. The fact that it has been amended so many times shows that quite clearly.

Re: US Supreme Court Justice Ruth Bader Ginsburg to Egyptians: Look to the Constituti

Ruth Bader Ginsburg said:
we were just tremendously fortunate in the U.S. that the men that met in Philadelphia were very wise.

Should a supreme court justice call our founding fathers wise?

Well, they did wipe their ass with a corncob. What do you think?

Look at the end of his post. See where is says "j/k"? That stands for "just kidding". He was making(and admitedly poor) joke. Let me know if you need any more help with those complicated internet acronyms.

Well, the founding fathers - being the infallible and all-knowing direct descendants of God and therefore incapable of getting anything wrong - never actually had to wipe their asses. That sort of unpleasantness is left to we mere mortals.

Re: US Supreme Court Justice Ruth Bader Ginsburg to Egyptians: Look to the Constituti

I think the US Constitution was written for its time and place, and certain parts of it are certainly feeling its age but we keep it up to date. However the Egyptians aren't the Americans, nor is their government or country structured on the same line as ours, for example the concept of a "United States" is completely foreign to Egyptian government, its just not how their country is organized. So everything having to do with state's rights and federal government powers would be meaningless to an Egyptian.

They should look to whatever Constitutions are best for their specific situation, and no American should have such a weak ego as to be insulted they aren't using ours or that one of the most knowledgeable and experienced people in Constitutional law thinks ours isn't best for this situation.

Re: US Supreme Court Justice Ruth Bader Ginsburg to Egyptians: Look to the Constituti

Our own government ignores the Constitution, and there is no mechanism of power other than open rebellion that lets the People regain control, so what's the point of copying our system? Its flaws are obvious. Not to mention big businesses are "persons" now.

Egypt should not copy the American system. At least Canada has a monarchy that can step in and dissolve the government if it starts to become too autocratic. We have no such protection, other than taking up arms.

Re: US Supreme Court Justice Ruth Bader Ginsburg to Egyptians: Look to the Constituti

Should a supreme court justice be advocating some other type constitution other than our own?

Considering how ineffectual our constitution is in these modern times, I think a supreme court justice has a moral imperative to advocate some other type of constitution than our own.

there is a kernel of truth in your claim

Re: US Supreme Court Justice Ruth Bader Ginsburg to Egyptians: Look to the Constituti

Yes. A Supreme Court justice should be so intimately familiar with our Constitution as to be able to recognize its weaknesses-- and be able to advise nations newly chartering Constitutions on how to make theirs better.

Loving your country means making it better, not believing it's perfect.

Re: US Supreme Court Justice Ruth Bader Ginsburg to Egyptians: Look to the Constituti

Perhaps some Egyptions might also look more respectfully at a non-american constitution in these times.

Re: US Supreme Court Justice Ruth Bader Ginsburg to Egyptians: Look to the Constituti

A very wise woman and sage advice ...look to the US constitution as well as other constitutions and allow people to have freedoms to exercise. There is nothing wrong with that. As a Supreme Court Justice she is an expert on the US Constitutional and has much to offer those countries which seek to use a constitution as an authoritative document. The US Constitution is not for everyone or every country in fact it was amended to fit the times and circumstance on 27 occasions.

I think that someone whose job it is to make court room decisions based on the constitution should have a really high regard for the constitution. I find it hard to believe that someone who does not have a high regard for our constitution can be fully trusted to do their job. Perhaps this is why she used foreign laws to influence some of her court room decisions. No constitution on earth is perfect and every constitution on earth can be subject to scumbags blatantly misinterpreting it in order to screw people out of their rights.

What makes our constitution inflectional is due to scumbag politicians subverting the constitution and supreme court judges making rulings based on their political bias.It has nothing to do with the constitution itself. This can happen with any constitution.

Which is ludicrous since effective constitutions must take into account scumbag politicians and supreme court justices making rulings based on their political bias.

What makes you think she doesn't hold our Constitution in high regard? Just because she doesn't think Egypt should use it as an example, thats going to be a tough argument to make.

Re: US Supreme Court Justice Ruth Bader Ginsburg to Egyptians: Look to the Constituti

If anyone can point out the similarities between 1700's America and modern Egypt that would make the US constitution the most viable solution, be my guest.

The federal government and states all across the country have misinterpreted the 2nd amendment in order to infringe upon it even though the constitution blatantly says the people have the right to keep and bear arms and that it shall not be infringed. States have DUI checks and the TSA has virtual strip searches and invasive pat downs ever though the 4th amendment says you need reasonable cause or a warrant to search someone. These are pretty clear amendments. If something like that can happen in the USA which is a pretty great country then something like that can definitely happen in other countries regardless of how well written their constitutions are. Scumbags in office will use the "its for the public good" , "it was written at a different time" or use the "we have different technology today than they did back then" excuse as a means to **** on that constitution.

And she indicates in her interview that she has just such a high regard for our constitution. You are making a mountain out of something les than a molehill.

Which does not in any way invalidate what I said about our constitution.

Which amounts to someone saying they support the 2nd amendment before enacting all sorts of infringements on it. If she had sch a high regard for it then she wouldn't be basically dumping on it by telling other people to not go with ours but instead go with some other country's.
