SAN FRANCISCO — The so-called birther movement was dealt another legal blow Thursday when a federal appeals court tossed out a lawsuit challenging President Barack Obama's U.S. citizenship and his eligibility to serve as commander in chief.The 9th U.S. Circuit Court of Appeals ruled that none of the challengers had legal standing to file the lawsuit on Jan. 20, 2009, the day Obama was inaugurated. The three-judge panel cited various reasons for disqualifying six sets of plaintiffs, who included Obama's political rivals, taxpayers and military personnel.The birther movement has filed multiple lawsuits over the issue, so far with no success. Its leaders have lost similar challenges before the U.S. Supreme Court and the California Supreme Court.The U.S. Constitution says only "a natural born citizen" may serve as president. The challengers allege that Obama, whose father was Kenyan, was born in that African country, rather than the U.S. state of Hawaii. They claim his Hawaii birth certificate is a forgery.

I believe that brings the tally of birther suits lost to 4 federal appeals, 8 federal trials, 4 state trials, 2 state appeals. Orly Taitz has only been fined for bringing the ridiculous suits once, but if she tries it another time they'll give her a crushing fine I imagine.
 
I say let it proceed to the Supreme Court. Justices are people too, and they also would appreciate a good belly laugh.

They've denied cert (meaning the decided not to hear the case) 3 times already. They only have room on their schedule for about 150 cases a year, so sadly, they don't have much room for these joke cases :)

The SCOTUS would probably be the one court to rule, 5 to 4, that Obama was a Kenyan.
 
We--Republicans--had better bring our "A Game" in 2012, offering genuine solutions to the legitimate issues concerning the American people, rather than continue with spinning the wheel to guess where in the world was Mr. Obama was born. Time to get off that merry-go-round
 
There is another reason to toss the lawsuit. Presidents actually are elected state by state. . Basically all states have a deadline to challenge a candidacy and election - to stop a certification. If that deadline passes or certification not enjoined, the outcome certication is a finality.

A deadline is just that, a "DEAD LINE." Past that line, your case is DEAD. Deadline rules are not meant to be fair. They are meant to absolutely restrict. Deadlines are absolutes exactly as statutorily defined. There are not equitable exceptions, only exceptions - if any - allowed by the deadline statute itself.

Any attorney could confirm that concept. Once a state certified the result - and that is not blocked or enjoined by the "deadline" to do so, even a confession by Obama and video of his birth in Kenya would not change that he is still the President.

Regardless of you opinion, its a legally dead issue. And yes there is a huge problem of whether anyone has standing to challenge it anymore either. Other than Congress pursuing impreachment (never gonna happen), there is no legal remedy left regardless.

Well, I think that if someone could prove that Obama is not legally allowed to hold the office, Congress might impeach him. Outside of that they're not going to impeach him on this, and as far as I know nothing he has done to this point. (Being a bad President isn't actually a crime...)

No matter what, Obama is way to secretive for my taste. When you are secretive, you are hiding "something".

ive never been on the birther bandwagon.....iv juggled the idea and it could be possible he pulled a fast one, probably not but i cant shake the thought that in the early 60's, a single white woman gave birth to a black child in Hawaii, that wasnt a common thing.....it just seems somebody would step up and say..."hey i remember them!"...wether it be a hospital staffer, his grandparents neighbors, a store clerk.....anybody

The Birther Movement is based in bigotry. Their bigotry is rooted in their ignorant fear of anything or anyone different from themselves. That kind of fear will not be resolved until they f
find the courage to become educated.

The culture in Hawaii is nothing like the culture on the mainland in regard to racial prejudices. A biracial child would not have caused the stir it would on the mainland.

and as far as 70 years (higgins)....both my parents are in there 70s and they can recall details of events back to there childhood

It would be nice to see the articles he wrote in College or grades.

That seemed to be standard operating procedure for vetting candidates for office, as was seen in 2000 and 2004.
