A Los Angeles police commander says his department could investigate an alleged sexual tryst between an underage Justin Bieber and a now 20-year-old woman because it violates California's statutory rape law.

Cmdr. Andrew Smith said Thursday that no report has been taken about the October 2010 incident at Staples Center. However, police could look into the matter after various media outlets reported Mariah Yeater filed a paternity suit earlier this week against Bieber.




He's annoying, and I feel for their child but sometimes justice works in mysterious ways. If he was underage, I hope she faces the consequences.

I mean, it's maybe a little weird but "permanently on sex offender list" criminal?

It'll only be a misdemeanor.

California's age of consent law said:

The age of consent is 18, with a misdemeanor if the minor has 3 or fewer years of difference with the major, and potentially a felony if the major is more than 3 years older. It is worth emphasizing that unlike most other states, the close-in-age rule in California (3 years) do not provide an exception nor provide any defense; it merely lowers the crime to a misdemeanor. Under this law, two minors of the same age could both be prosecuted. Penalties increase if the minor is under 16 and the major is above 21 or if the minor is more than 3 years younger.

16 is much younger mentally than 19, compared to 31 and 34. If I have a daughter or son at 16, and a 19 years old propositions them to have sex, I would think of it as my child being taken advantage of. Or maybe my child instigate it, I still think the older party should refrain. I can imagine sueing for statutory rape.

But age is not my beef here. My problem here is that, she might have had sex with him, got pregnant, believe it's his, but didn't make it known until the child's born, only to then sue him - my guess is there's monetary motivations. That's why I call it justice: she sued him, and she might get sued right back.

It'll only be a misdemeanor.

If the Law says it's a misdemeanor, it's a misdemeanor. The fact that she would be found guilty if what she alleges is true is justice in and of itself.

Many states thats not even a crime....15 is the age of consent, actually im wrong..wow...Im glad I went and checked...I know NJ used to be 15 they must have changed it back to 16. Below is a list of consent age for each state...I was surprised to see some 17
