Governor Brown Vetoes Warrant Protection for Cell Phones

SB 914, written in response to the California Supreme Court decision in People v. Diaz, upheld basic constitutional principles. It just maintained Fourth Amendment protection to the contents of cell phones, requiring officers to show a judge there is probable cause that the phone has evidence of a crime before it is searched incident to arrest.

Another sad but expected blow to the fourth amendment. Thankfully that here in NY the state still needs a warrant to search a cell phone....for the time being.

Wow, if Bush had done this the left would have been screaming. To be fair, perhaps they will complain here. I'll eagerly await seeing the complaints.

Both of you have selective memories to the point of sheer idiocy. Liberals have been opposing these sorts of things all along. Some conservatives have been saying "IF YA AINT GOT NOTHIN TO HIDE!!!"

If this is where your focus is, then no wonder government is able to destroy the 4th amendment and its protections. Your first knee-jerk reaction was to look at the partisan angle, instead of looking at how warrantless cell phone searching is wrong and a violation of what our Constitution stands for, REGARDLESS of a (D) or (R) implementing it.

You sound like that I never slam the right on these things, you should know me better than that. If anything the police state right is more honest about their love of thugerment with the commonly squawked phrase "law and order" vs the police state left.

Granted this is not a national thing so the news isn't going to be as easy to find but I've been looking. I've seen very little in the way of complaints.

Now, I do not think you will find where I ever defended where a (R) did it or anyone for that matter. It's legit to point out that those who yelled the loudest when Bush did something like this now seem to be quiet. That is why we the problems. If you ever see me defend one party for something I'd slam the other for, please, feel free to speak up.

If it helps, this is outrageous!!!! Such a blatant disregard for the Bill of Rights is a traitorist act. I don't care what political stripes you choose to wear, in the end, you are a disgrace to your office.
